ILR - PBS Dependent Route, online application doubt

Hello everyone,

We are in the process of applying for ILR for my partner via PBS dependent route (Tier 2 Dependant).
She entered UK on '6 March 2015', current visa valid till 2022.

While filling the SET(O) we had concerns about section 'Immigration History' & 'Immigration Details'

Does my partner need to fill out the absences since '6 March 2015' ?

Is SET(O) the right application as we don't see options to enter last 5 year absences.

With-in the application we see the following questions :

'Personal Details' Section
Does the period of stay on which this application was based include any leave granted since 11 January 2018?
Have you had any absences from the UK during any leave granted since 11 January 2018?

'Immigration History' Section
Which countries did you visit or travel through when absent from the UK and Crown Dependencies?
When did you leave the UK and Crown Dependencies?
When did you return to the UK and Crown Dependencies?
What was the reason for this time spent outside the UK and Crown Dependencies?

~Add another absence~
'Immigration Details' Section
Have you previously lived in a country outside the UK including your country of birth?
~Add another country the applicant has lived in~

we can see these questions, don't understand why it is referring for absences since '11 January 2018' though we are applying for 5 year route!
Even the guidance is using this date in here - https://www.gov.uk/guidance/immigration ... ly-members
Are we missing something here? Absence count has been introduced in 2018 only for dependants?

We only had one absence since '11 January 2018', would that be enough or we need to enter other details under 'Immigration Details' Section, covering travel to Home country or any other country in past 5 years prior to '11 January 2018' ?

Also this question :
'Have you previously lived in a country outside the UK including your country of birth?'
Does this mean we need to enter a record saying that my partner lived in her home country since her birth?

Not sure if we are over thinking but did not understand which is way to proceed further with out application.

Any help would be appreciated.

Because PBS dependants do NOT have an absence limit for ILR unless they were issued leave to remain on or after 11 Jan 2018. If she was NOT granted any new PBS dependant visa on or after 11 Jan 2018, there is NO NEED to enter anything.

Apologies if I wasn't' clear.

Once you complete the form you will get a documents checklist. Cohabitation documents are needed but usually not mentioned in the checklist as its not always correct. You must follow the official guidance for which documents are needed.

Hoping it should be ok to continue this thread to ask some questions about our application.

In the check list, I can see the following, want to make sure we are choosing the right documents, please help me with this.

Mandatory documents
The passport issued by Country X for Applicant
- Current Valid Passport of the applicant

Other documents
The degree certificate for Applicant to prove the level of English language required
- Applicant's degree certificate
Evidence of Applicant's immigration status in the UK
- What should we have here?
Declaration signed by Applicant's Partner to confirm consent for the Home Office to request
verification checks
- I've signed Part 2 & Part 3 and applicant signed Part 1
Current Biometric Residence Permit for XXXX
- Current BRP
All previous passports, travel documents or national identity cards that you have used to travel to or
remain in the UK
- Old Passport


Also, to prove our co-habitation, do we need to upload all 5 years documents or last 2 years should be fine?

Passports
BRP
Appointment Confirmation Letter
Marriage Certificate
Kids Birth Certificates
Anything we are missing?

Do we need to carry every original document we upload on sopra website? I mean utility, council tax etc..

If you can no harm, its to cover all bases and avoid regret should any of the documents uploaded be missing or illegible.

But for documents such as bills like Gas & Electricity, Council Tax, Water etc which were produced online by PDF's, should I carry them as well by printing?

Also, do we need to print the full application and take it to appointment?
We don't need to produce any photographs I believe?

Yes if you wish so but these most often aren't asked rather the original passport & BRP card only for identity check

Just wanted to clarify about travelling outside of UK.

Since my partner applied for ILR in October, submitted biometrics in October, is it ok for my partner to travel outside of UK? My partner still has visa till March 2022 on current BRP.

Please advice.

You will not get a refund after biometrics done. Also, as long you partner has valid leave to remain, yes you can apply again.
