HELP!!

Post by lil lost brit » Sun Aug 24, 2008 2:57 pm

Hi guys n girls,
im new to this forum so please be nice :D. I recently moved back from Florida to southern England. Before Florida i was in Montana. In Montana i went to high school but never finished, i loved it there, id never been happier. I moved back because my dad (and sponser) plans to move to Costa Rica early next year and i did not wish to follow him. I desperatly want to get back to the usa and high school, i dont really know how to go about this or if its even possible, hence why im here lol. I am a British citizen and a permenant US resident too but thats not going to carry on once my dad has left the country, im guessing. The only ways i know of getting sponsership is, getting married, having family in the US that are permenant residents or more, through an employer, or by starting a buisness and employing to americans? If i wish to go to high school i dont think any of these are possible are they? Can any of you see a way for me to get back to Montana and high school?? Please help me! lil lost brit

Have you got a green card? If so, you have that (normally) independently of your parents.

But a green card can easily be lost if you are no longer living in the U.S.

No, it doesn't mean anything. Maybe he sponsored your card, but after you receive it you have no sponsors...You're independent.

I don't understand the issue. You have valid green card, correct? It is not conditional, correct? If it is conditional (means it is for 2 years only and then your sponsor has to apply to remove condition). If you have 10yr green card which is valid you do not need anyone and can enter the country and work or study wherever you want.

I am not sure what a green card is, but i do have, a social security number, permenant resident card, and a work permit. The confusion is that my father told me that im am reliant on him being in the country or my things become void, he is not a very reliable source i might add. But thanks to you both you have helped me alot and i plan on moving back very soon, i am to get in contact with a property manger soon. Any other responses are more than welcome, thanks again.

The permanent resident card is the "green card". In the very olden days these used to be printed on green paper, and the name somehow stuck. If you have a green card you can go back on your own. The only problem is that if you stay in the UK for a long time you run the risk of losing your permanent residence. As a rule of thumb, if you stay in the UK longer than six months you may have problems and if you stay longer than a year you may have lost your PR. So the sooner you get back to the US, the better. If you plan to stay in the US for a long time it might be a good idea for you to apply for citizenship as soon as you qualify.

Your permanent residence card is also a work permit, you don't need a separate document to work. When does it expire?

Your 10 year green card - "Permanent Resident Card" - means you can stay in the U.S. independently of your parents.

You do not need any permit to work.

After 5 years, you can become a U.S. citizen. If this is what you want, you should stay in the U.S. until you get your citizenship. Then you can live wherever you like and always have the right to come back to the U.S.

If you leave the U.S. for anything other than a vacation (before you become a citizen) you risk losing your green card.

:D Just so you know your card expiration date is when your CARD expires not your status. You will still be permanent resident: you will just need new card.

Similarly, it is possible to lose permanent resident status (eg by spending too much time outside the U.S.) while the card is still valid.

If you had a green card then you didn't need a work permit. What kind of "work permit" do you have?

The green card is all you need to live and work in the US. The "work permit" you have is probably an older visa you were on before you became a permanent resident (green card holder).

I don't know. I suggest you ask in the following forum. A couple of experienced immigration attorneys regularly post there and they may be able to tell you

I think your father is either lying or simply wrong. I've had a look at form I-407 (here) and there doesn't seem to be a way it can be filed on behalf of someone else. Perhaps your father filed it for himself and assumes that this cancelled your green card as well. If so he's wrong. But do ask on that other forum.
