Will I get naturalisation?

Hello moderators,

Please please help me.

I am a Non-Eu Citizen in UK

I came to this country in September 2011 for Masters and completed in August 2011. During that time I had 20 hours per week work permit and I joined a company to work there while I was studying.
I renewed my visa for another course in Sep 2012 and when I got the visa I got "NO work" remarks on Tier 4 BRP.
But I continued working; but after few months when company asked my Biometric card, I have them and they immediately terminated me because I had "No work" remarks.

But due to my Masters I could get Tier 2 sponsorship in Aug 2013 and joined a company as a graduate and got my Indefinite leave to remain in Aug 2018.

Now I am planning to apply for Naturalisation as I have been on Indefinite leave to remain for 2 years already
I was filling a form and there is a question

Have you had any other work over the past 10 years or since you came to the UK? -
Do I need to put the work I did also?
Is my application likely to be refused?

Please guide me

The user posted a disrespectful and derogatory post, second one they have posted in the last couple of days.

If you have breached your visa conditions, then yes you risk a refusal. You are required to list all your employment and yes HO do check other government department records.

Hello

There is nothing mysterious here.

Yes you have to declare everything. If you hide something of this nature, they will find out anyway as your employer was making contributions on your behalf.

Yes, there is a risk of refusal under the "good character" requirements. It's a break and can trigger a refusal.

You can either try now but keeping in mind that there is a risk of refusal or wait until 2022 to apply.

Nobody can go back and change the past. You breached the conditions of your leave, so there is a risk of refusal. Nobody can tell you if it is 20% or 90% but there is a risk.

If you want to avoid a refusal, wait 10 years after the breach and apply.

As I got my tier 2 in Aug-2013
So according to should I apply for Naturalisation in 2022 or 2023?

I don't mind waiting I just want to know If i am able to get naturalisation in future.

So If I apply for naturalisation in 2022/2023 then do I not need to declare about the work I did in 2012-2013?

You always declare but they disregard a breach if it happened more than 10 years earlier.

In your can, if you got your Tier 2 in 2013, then apply in 2023.

You can try now if you like, but you risk to lose the application fees in case they refuse you. I am not telling you, they will certainly/100% refuse if you apply now, but there is a refusal risk obviously.

I don't mind waiting.

Just a question out of curiosity, If they refuse Naturalisation Do i loose status of my ILR also?

The two of them are not linked. Naturalisation is a privilege. Unsuccessful applications will not trigger a review of ILR.

Aug 2023 no risk, so Will go with that date :)
