Hi,

I became British Citizen through TIER1 VISA Process in the Year 2018 but now I would like to apply for my KIDS citizenship and my wife is not applying along with them.

So in this scenario, Could you please suggest which option should be selected in the Online Application Form ? Can't I just apply for Kid's citizenship or is it mandatory to have one of the parents apply for Citizenship along with the kids?

Following Options in the Online Application Form so not sure which to choose

"Your parent is British by descent and lived in the UK or a British Overseas territory for at least 3 years before you were born"

"Your parent is British by descent and you and your parents (unless they are legally separated) are now living in the UK or a British Overseas territory"

" One or both of your parents is applying for British citizenship"

" Other - apply at the discretion of the Home Secretary"


I am using this form in the online "Apply for registration of a child under 18 as a British citizen" Please confirm whether this is the form that I should fill for my kids.

If they are under thirteen or have resided in the UK for at least two years, then they should be okay to register them under Section 3(1) using form MN1.

Please see below for my replies -

How old are the kids?
Elder one , 7 Years Old


Younger one, 4 Years Old

How long have they been residing in the UK?

Elder one , since Jan 2014. However, he was out of Uk for more than 850 days between 2014 & March 2017. Since 2017, he was out of UK for just 30 days.

Younger One, She was out of Uk for just 90 days. Born in the year Feb 2016 and came to Uk in July 2016.


Hope, I have not complicated with my response. Are they still eligible to apply for Citizenship, kindly advise !

I was filling up this application form - "Apply for registration of a child under 18 as a British citizen"
but the Form MN1 Link you have shared says "Apply for citizenship if you were born in the UK"

Kindly advise which form should I fill please.

Is there any condition that he / she should have lived in UK for 3 Years or 5 Years?

As stated in the earlier thread, My son is out of UK for 850 days between the Year 2014 & March 2017.. But from March 2017, he has been living in UK and visited India for 30 days only.

I am back again with few issues , sorry for that ! Kindly go through it and advise !

1. Clicked the MN1 Link which Vinny has kindly provided; When I clicked that, I see this Register child under 18 as British citizen (form MN1). But again, I get the same questionnaires like "Your Parent is British by descent, etc, etc" so I couldn't decide whether this is the right one or not because the options showing under doesn't related to me.

Then I selected the following link and continue to fill the data and the form name showing as "Apply for British citizenship by naturalisation". Is this right one?

2. While filling through the above application form, all the fields or the information that to be filled in is related to an Adult but not for a kid.

3. I was told that for the Kids under age 13 is not required but I get the following to provide under the Documentation Required " Proof of living in the UK for ******* for 5 years if applying in your own right or 3 years if applying as the spouse of a British Citizen"

If you are a Non-EEA National, you need to include your passport to prove you have lived in the UK for the relevant 3- or 5-year period

4. Fees for applying British Citizenship is £1,012 but I get the following to pay - Is this accurate ?
Standard service : pay 1349.20 GBP, most people get a decision within 6 months of submitting their on-line application


5. I filled following form but the fees showing more and it expects my son to Iive in UK for 3 or 5 years and need to show the proofs.

6. Also tried to fill the following link, which is form MN1, showing as Register for British citizenship as a child under 18"

I get the same questionnaires like "Your Parent is British by descent, etc, etc"

I am sure , I am clearly confused !!!

Can you kindly advise which form should be used for my kids - providing my kids information again for the reference so that you can advise me accordingly.

- I am from India, because British Citizen through TIer1 Process in the Year 2018.
- My both kids born in India, aged 7 & 4.
- My wife is not applying for British citizen along with them; all my family members are Indefinite Leave to Remain Visa .

I tried this form in the beginning but I get the following options to choose but none of them are relevant in my case; May be I misunderstood so since I already provided my and Kids' visa situations, Kindly advise which option to choose and proceed from the following please -

1- Your parent is British by descent and lived in the UK or a British Overseas territory for at least 3 years before you were born Is this Option suitable for me? By descent means, either me or my wife should have born in UK right? but we both born in India

2- Your parent is British by descent and you and your parents (unless they are legally separated) are now living in the UK or a British overseas territory. Is this Option suitable for me? By descent means, either me or my wife should have born in UK right? We both born in India

3- You were born on or after 13 January 2010 and your parent was serving in the UK armed forces

4- You were adopted abroad by British citizen parents

5- You were born before 1 July 2006 to a British father and your parents were not married

6- One or both of your parents is applying for British citizenship .. My wife is not applying for Citizenship ayong with them

7- Other - apply at the discretion of the Home Secretary

Yes ! Trust me, I indeed started but on the recent link you provided, if I am clear which option to choose , then I am good to proceed. I am just stuck only at selecting the relevant option.

Can you kindly advise which option to choose out of 3 highlighted option please?

In relation to the Option 7, this can be selected for those Kid's Parents became British Citizen through Tier 1 Process right?

Looks like I am miserably failing to under the Option1 & Option 2. Depend on my situation, can you please advise that these options are not for selection for my case. That will give bit of relief so that I can go ahead and select the Option 7.

British by descent is someone who is born outside UK to a British parent who was British otherwise by descent i.e. a naturalised British. You are not a British by descent. You are a British otherwise by descent.

If you have any future child outside UK now, since you are a British Citizen by naturalisation yourself, your child born abroad will be automatically British by descent.

You will choose 7. Citizenship is not an entitlement for your kids since they were born abroad before you were British. It is at the discretion of Home Secretary.

Hope, Citizenships will be granted successfully though the Option 7 is selected; It's just a doubt as I am not sure what are all the parameters they will be considered while evaluating the application.

When there is no entitlement to be registered as British Citizen, all applications are decided at the discretion of the Home Secretary. It is normal. This is how it is. No reason why it should not be accepted.

I ran a dummy form. The form will ask about parents Nationality later in the form. You must mention your nationality as British there.

Apply for registration of a child under 18 as a British citizen , chooses the following options:

You were born outside the UK
Other - apply at the discretion of the Home Secretary ( Choosing this option as none of us are applying for British Citizen along with him; I am British Citizen by Naturalization)


Few Questions so please could you help to clarify-

- Do I need to send my British Citizenship Passport along with this application? Also, Do I need to send my Son's Original Indian Passport or just scanned copy is enough?

- My Son has lived for nearly 3 years outside of UK in the past 7 years. Can you advise whether this impacts the application for British Citizen? He is 8 years old, born on 24th Feb 2013.

- Under Declaration, 2 Options. I am filling this application on my Son behalf. I think I should select the 2nd option, Please can you confirm?

○ I am the applicant
○ I am a representative of the applicant and have been authorised to act on their behalf and have discussed and confirmed the contents of this application with them

- Referee Declarations: It is mentioned as the follows; Can you advise whether I can request his school management to sign as one of the referee? Not sure whether they can sign, but can you advise whether I can reach out them for this? My Son in in Year 4, known to the teacher for the past 2 years only . Is this enough or should have known for the past 3 years?

○ Declaration - Referee 1:
Each referee should know the applicant personally.
Where the applicant is a child applying, one referee should be a professional who has engaged with the child in a professional capacity, such as a teacher, health visitor, social worker or minister of religion.
○ Should I send the hard-copy to UK Visas and Immigration? Can I Scan it and then upload in the same ONLINE FORM MN1 Application?

- Since I am applying under Option Others & Home Secretary's discretion, do I need to fill anything under this section? If so, can you advise what to fill over here?
Do you have any other details that you would like to be considered regarding this applicant and their application to be registered as a British Citizen

Please, could you help to clarify the doubts I have. I did create this thread in the Year 2020, got clarified on most of the questions however I dropped the plans to apply for citizenship for my son.

I am planning to submit the application next week so I request you to clarify on the questions posted please.

All documents are scanned digitally. Your son is required to attend biometrics at UKCVAS and he must take his passport and BRP card with him.

There is NO absence limit for children.

Option 1. Option 2 is for a lawyer or immigration agent representing the applicant.

Once signed, scan and upload. Don't forget to put the applicant's photo on the both referee declarations.
