Question regarding my current UK immigration status

Hi all,

As part of my application for EEA (EFM), I need to state my current immigration status. I am confused as to what to write because of my situation.

This is my current situation:
  • Applied for EEA (EFM) late June 2020 - received refusal letter November 2020
  • I was in the UK under a T5 Youth Mobility Scheme, which expired in August 2020
  • I am staying in the UK without a visa as I was waiting for decision
My question is, am I classified as an overstayer? How should I answer the following questions?
  • What is your current immigration status in the UK?
    • other: overstayer
  • Have you ever remained in the UK without permission (that is, after your leave to enter or remain, EEA residence document, or other permission, has expired)?
    • Yes
  • Have you ever been refused a visa for, or permission to remain in, any country, including the UK?
    • Yes
    • Reason for refusal: insufficient evidence
Are these appropriate answers?

Hello

Unfortunately you are an overstayer without legal status in the UK.

Your Tier 5 expired in August then your EEA EFM was refused in November, this puts you in a situation where you have nothing in hand as far as immigration is concerned.

EEA EFM are never straightforward as they involve some degree of discretion from the Home Office. They bar is placed high when it comes to evidence. You need to show a cohabitation with shared financial responsibilities and commitments. Such as having joint bank account, joint loans/credits, having both your names in bills...
