BRP renewal for ILR-holding dependant who studies abroad

Post by StG » Sun Nov 22, 2020 12:14 pm

I am a British Citizen via naturalization via Tier1 route.
My son got an ILR together with me in 2016, and his BRP card is due to expire in 2021.

Last 2.5 years my son went to study at university of our home country, with a view of doing a PhD or Masters here in UK.

Reasons behind choosing a university there were about it being free and also being very good for physics and maths. He comes back on breaks and hasn't been out of the uk for more than 6 months continuously apart from the initial wave of COVID where air-travel was disrupted (when he ended up being outside for 7 months).

I would like to understand
1) if studying at a university outside of UK affects my son's eligibility for replacement of BRP card
2) whether I need to disclose the fact of him studying abroad within the application
3) i seem to have a difficulty finding an 'evidence of continuous residence' for 2018 for him, wondering if that's going to be a big problem
4) the way it stands now there is no super-priority service for BRP replacements, the processing times are six months and they require for a person to stay within the UK the whole time of the application. Does anyone know if in practice the applications are served faster than that? Does it mean its going to be straight cancellation/refusal if he leaves the country while the application is in progress?

much appreciate your help

Thank you

Other than proving that the ILR holder hasn't actually lost his status by remaining absent for more than 2 years from UK, nothing else will have any significance assuming no devil in the detail. But still you would be required to disclose your absences truthfully along with the reasons which obviously will be studying in your case. Also, regret to say that these/similar applications do tend to consume considerably lengthy amount of time as per from member's experiences. And, travelling while awaiting the outcome of a pending application for BRP is always interdicted.

just one more question on a relevant matter (don't know if I should start a separate thread?)

the official guideline on timeline for BRP replacement is to apply not more than 3 months in advance;

does it meant to be precise to the day, or can be done w.r.t. to the calendar month precision?

say if expiry date is on 23rd of March, is it OK to apply on 1st of December, or does it have to be not earlier than 23rd of December?

Thank you!

Better to follow the guidance and don't apply before 23rd Dec.

just an update for everyone's benefit - following the application in Dec and biometric appointment in Jan we just received the decision letter via email, saying that we should have the replacement BRP card delivered within 7 days

thank you everyone
