Hi team ,

I hope everyone doing well I would like to discuss about my immigration situation .
This year January 23 I applied for PR ( EU family member 5 years route) I got the refusal letter from home office like my wife is not existing the Teri Teri right even though I submitted all my papers pay self , self employment letter HMRC,& joint statement everything. I don’t know why they refused my application and later I did my appeal sep3 I got the confirmation like they are accepted my appeal on sept -21 , after that I haven’t got any confirmation . I called to tribunal they said your case is with case worker Is there any why I can contact case worker team to send the all the papers again proofs . Could any one help me please

Why wasting time for PR
When is guarantee that you get settled status with no stress.think twice

As the non-EU family member, your own employment and financial situation are completely irrelevant for EEA applications. It is the EU sponsor, in this case, your wife, the one who needs to prove they are exercising treaty rights (working, looking for work, studying, being self sufficient), not the non-Eu family member.

Two key questions:

1. How is your wife exercising treaty rights?
2. What is your current immigration status? (In case she is not exercising treaty rights)

1) Sorry it’s typo error she was registered as self employed 2014-2020 . Paying properly taxes every year , I got all the records like evidences , bank statements, HMRC mail confirmation and also she contributed her NI tax as well ( related ni-tax I got the salery bank statements, payslips , everything I got .

2) I got the residence permit until 2021-July

3) my visa is valid until 2021-July I am planning to travel to India in December can I travel could any one confirm please .

OK, in this case, if you absolutely want to clarify why you got refused for PR it would be helpful if you shared the exact wording of the refusal letter, omitting any personal references like your name.

What is your full immigration time line? When did you arrive in the UK? When did you get married? You might or might not have already completed the required 5 years, maybe?

As the previous poster said, depending on your situation, it might be easier for you to apply directly to the Settlement Scheme. Answers to the above will clarify wether this is the case.

If you do not apply for the Settlement Scheme, then your card is guaranteed to expire on December 31st 2020.

If you do apply for the Settlement Scheme, there is a bit of a grey answer here. In theory, the validity of EEA cards that are used to apply for the Settlement Scheme will still be valid past December 31st 2020, until their printed expiration date. In practice, no one has been able to point to a public document where this extension is clearly guaranteed. Read this post for a recent dicussion on the topic.

Hi Kamoe please find my immigration history :

1. came to uk 25/09/2011
2. Got the university student visa from 20/09/11 to 30/11/2013
3. Apply one more extraction from university 10/12/2013 to 01/10/2014
4. Married Eu national & applied for Eu residential permit 29/09/2014
5. Processing time got delayed but finally got the visa - 21/07/2016 to 21/07/2021
6. Apply for PR-23/01/2020.

If you were still married, if your wife was still exercising traty rights, and if there were no gaps in your UK residence at the time you applied for PR in 2020, then you should have been granted it. Again, no way to help to shed some light on the reason of the refusal if you do not share the exact wording of the refusal letter.

Again, another option for you is to simply skip PR and apply for the Settlement Scheme directly. Has your wife applied?

Oh it is an actual physical letter? Not an email? I was thinking you could just copy paste it; deleting any personal info.
If that's too complicated, then leave it. What is the reason of refusal? Can you type/copy the one sentence that says why?

... just focus on getting Settled Status. Once your wife has applied, apply yourself. You'll need her application number, and scan and upload your marriage certificate and your current EEA card. Likeliest scenario is that you are granted Settled status.
