Applying for Citizenship for kids concern about fees after court ruling £1,012 fees unlawful

We have two kids born in the UK(age 3 and 7). me and my wife recently got the UK citizenship/passport on EEA route.

We holdoff for kids Citizenship application due to the court order last year about the fees of the application.

We hoped that the fees will go down but till now i cant see any signs of Home office to change the fees as soon if ever they do..... as i heard that the case (fees for kids citizenship application) is back in court!!

I am just trying to understand my options if some one can please clarify.

1) as my wife is EU citizen and we got our citizenship on that route, so what will be the status of the kids after December. or do we need to apply for settle status for kids

2) if we apply for citizenship for the kids now, are we able to get refund in future if the court rules against the amount of fees charges?

Their status will not be automatic. Settled Status applications are free, so yes, I would suggest applying for that for the children.

Unlikely. Generally judgments are only prospective, unless the judge explicitly states that it should be counted back to a specific date.

One more point if you can clarify please.

If we apply Settle status now, and maybe in next 6 month we like to apply for citizenship for little ones, can we do it or do we need to wait 12 months before making citizenship application?

Just like to mention, currently our kids dont have any passports.

Children born in the UK do NOT need settled status etc. They have an entitlement to register as British once either parent is granted settled status or PR.

They also do not need passports to register as British.

EEA nation, We acquired PR and later on British Citizenship after our two children were born(current ages 3 and 7)- both born in UK so they are not entitled to British passports unless we apply for Citizenship now (but we holding off as currently the cost is about 1000 pounds each)

_ we are a bit concern as the register date for EU Citizenship is approaching near (30th June), so we are not sure if registering of our kids will be helpful or not, any advise from professionals would be really helpful ?
_Also as in the below article, the Home office has still not reduced the fees , has any one has any experience applying recently for their children ?

30 June is the deadline to apply for UK (pre-)Settled Status - this has no bearing on childrens' registration or naturalisation.
The fees for registration are still on the statute book and payable if you apply now - Home Office are reviewing their guidance but we don't have an indication as to when that will be completed. Also it is not clear whether there will be a blanket scrapping or reduction of fees for all scenarios which are applicable to registration.

So we have now decided to go with the application for our kids before the end of the month.

Just to check two points if some some can clarify please.

my self and my wife are dual national at the moment, so basically British and hold another nationality.
- can we just use the form MN-1 for our kids (as currently they don't have any nationality although born in UK but either me or my wife every applied for our native country citizenship for our kids)
- so in the form for MN-1 they ask for current nationality for children, can we mention my wife native country as she is from EEA nation country.

I believe you state their nationality as is.

if I get correct you mean to say we need to state there current nationality (as it is) but currently they don't hold any nationality , I understand that we can say they inherit the nationality from us (Parents) but if I try to blank (not select any thing) the option for current Nationality for applicant(children) in the online form, it doesnt let us go to next page, so need to mention something here, I think I can put my wife EEA country nationality but would like to get advise on this please.

- also just to confirm if MN-1 is the right form for us to apply for our kids nationality(parent are both dual national including British national, also my wife other nationality is an EEA nation country and both my kids were born in the UK).

I expect child would be automatically EU citizen so state the nationality.
MN1 is the normal form to register children, irrespective of parents' nationality.
Though I leave it to others to confirm.

-One more point if any one can please clarify , after filling the mn-1 form, in the end it asks to check the documents that we need to provide.
-If xxxxxxxxxx has a passport then provide this with your application. If Mr xxxxxxx does not have a passport then you must provide another officially-issued identity document. This could include an official travel document or national identity card.

I am not sure about the above point, shell we not check it?, as currently we only have birth certificate of our kids

I have applied for kids now and have also booked the appointment for the biometric. I am currently uploading the documents and one point in the checklist is a bit confusing again as they are asking for any alternative to Identity document like travel document or national ID card, does the Birth certificate sufficient to this below check list point?

-If Mr xxx name xxxx has a passport then provide this with your application. If xxx name xxxx does not have a passport then you must provide another officially-issued identity document.
This could include an official travel document or national identity card
