Baby born in UK to parents with Tier 2 general visa

Baby born in UK to parents with Tier 2 general visa

Hi,

Our immigration status is as follows:

Mother: Tier 2 General visa expiring in August 2021. but eligible to apply ILR through 5 year route in June 2021.
Father: Tier 2 General dependent visa expiring in August 2021, but eligible to apply ILR through 5 year route in June 2021 along with main applicant.

Son: Born in the U.K. in Apr 2020. Recently got Indian Passport as we don't want him UK British passport now.

We are not planning to travel outside the UK with our Son so we've decided to wait until we apply ILR in June 2021.

I would like your advise on the below.
  • Do we need to apply him Tier2 dependant visa to cover his legal entry in UK until we(I, my wife and My Son) apply ILR in June 2021?
  • Or Can we apply him ILR straight away along with us in June 2021?
  • Will there be any issues for ILR if my Son don't have any visa until June 2021?
  • In an emergency situation, If we travel to India with my son. What are the options we have to bring my son back to UK? Can I apply Tier 2 dependent Visa from India for the short duration until June 2021?
  • I understood from different forums that NHS services will be covered only upto 3 months old only. How to access NHS services for my son during the transition period before we(I, my wife and My Son) apply ILR in June 2021?
  • Is there a way to cover him NHS access (e.g. Vaccinations, general GP consultation, Specialist consultation, A&E) during this transition period ?

SHOULD BE OK WITHOUT A VISA AS LONG AS YOU DON'T TRAVEL OUT OF UK & WANT TO RE-ENTER.
  • Or Can we apply him ILR straight away along with us in June 2021?
YES, ASSUMING YOU DON'T WANT TO REGISTER HIM AS BRITISH CITIZEN VIA MN1 FORM.
  • Will there be any issues for ILR if my Son don't have any visa until June 2021?
NO.
  • In an emergency situation, If we travel to India with my son. What are the options we have to bring my son back to UK? Can I apply Tier 2 dependent Visa from India for the short duration until June 2021?
YES, BUT YOU MAY BE STUCK UNTIL YOU GET VISA WHICH COULD TAKE A FEW WEEKS.

HEALTH CARE INSURANCE/ PRIVATE PRACTICES.
  • Is there a way to cover him NHS access (e.g. Vaccinations, general GP consultation, Specialist consultation, A&E) during this transition period ?
ACCESS TO EMERGENCY SERVICES / A&E SHOULD BE OK, BUT OTHERS MAY BE DIFFICULT I GUESS WITHOUT PAYING IHS.

BTW, YOU ONLY NEED TO GET VISA & PAY IHS FOR 6 or 7 MONTHS, SO BETTER TO GO FOR VISA IF THERE ARE CHANCES OF GOING OUT OF UK OR NEED TO USE NHS SERVICES.

I think the below one is right one?



Children born in the UK
If you have a child while you’re in the UK, they do not automatically become a British citizen.

You can apply online for their dependant visa. You must do this if you want to travel in and out of the UK with your child.

You’ll need to provide a full UK birth certificate for each child, showing the names of both parents.

For one of the question for my child's visa:

Has XXXX's sponsor agreed to certify your maintenance on their certificate of sponsorship?
If you do not know the answer to this question, ask XXX's sponsor. If the sponsor has agreed to certify your maintenance, you will not need to provide proof of finances, such as bank statements.



Should I need to select ? Yes or NO ?

My COS letter has the below line :

Tick to Certify maintenance for migrant ( and dependants, if applicable) - Y


Does it mean the maintenance covers for my child as well? My partner submitted bank statements by selecting 'NO' for the same question in the past.

Please advise whether I should select Yes or No, If yes - should I need to get any additional maintenance letter from my employer specifically for my child visa , If No - what are the options to show bank statements

As it's covered by CoS, i.e. "Tick to Certify maintenance for migrant ( and dependants, if applicable) - Y", you can say yes to that question.

You could also upload your bank statement if you have enough maintenance funds for your peace of mind, but don't need any additional letter from the employer.

Do you mean the main applicant's bank account statements (- 90 days) for maintenance funds ?
My child don't have any bank account.

Does my child need to attend for Biometrics part of this dependent visa application?

1. No one said it must be a child's bank account. The advice was you could submit YOUR bank statement for peace of mind.

2. Yes, biometrics appointment is needed for digital photo for children undr 6
