PBS Dependent - ILR SET(O)

Hi,
Please help me here on couple of issue where i am not sure.
Going to apply for my wife's ILR application using SET(O), she is PBS dependent on tier 2 general route. I become british citizen in the meantime. She does not work in UK and totally dependent on me.

1. As this is a solo application, does she need to provide cohibition documents ?

2. Do i(main Tier 2 migrant) need to send/show my bank statement. It never ask for the statements anywhere in the application.

3. In the documents section, there is two question which i am not sure at all.
A. "Is the account with a bank or utility company for which you have supplied information and supporting documentation held jointly by you and other people?" -- yes/no ??

B. "Does the account with the bank or utility company for which you have supplied information and supporting documentation relate to another person who is to provide you financial support?" -- yes/no??

Assuming you had secured settlement (ILR) not through long residence:

1. Yes cohabitation evidences would still be required from at least 3 sources covering the last 2 years with even gaps of 3-4 months. These can be in joint or individual names.

2. Not for maintenance but can be attached for fulfilling cohabitation requirement.

3. First consent form is signed by applicant whereas sponsor sign on 2nd and 3rd is marked as n/a.

We dont have joined bank account but utility bills are jointly named.
Sorry but may be i could not explain my point(3). In point(3) both 3.A and 3.B, there is option(radio button) to chose Yes or No. And this is where i am confused what to chose(Yes or No)
3.A. Think it can be yes as we have joint utility
3.B. Honestly have no clue what is this question is all about ??

Please advice what to chose for 3.A and for 3.B?

Yes utility bills in joint name can be used. Also the evidences including bank statements in solo names can be complemented too wherever the deficiency arises. Usually 6 piece of documents if in joint named or 12 in solo names or mix n match fulfill the criteria.

Say yes to 3a and no to 3b because it is regarding a third party which isn't the case in your situation.

Hi,
Please advice how many days maximum she can be outside UK to satisfy ILR requirement ? Not sure about the 180 days absence rules, please provide bit detail idea about this 180 days rule.

She got her PBS dep. visa on 10/04/2016, came uk 07/05/2016.
** no absence till next extension

Her Tier 2 (General) Dependent extension was given on 29/03/2019.
Absence: 20/11/2019 - 01/01/2020

She will only list this. She is fine. The absence limit is 180 days on rolling basis on any leave granted after 11th Jan 2018 only.

as she is planning to go holiday now for few months.

In simple words, does it mean that she can be maximum 180 days outside UK on any 12-months period ?

180 days in one go OR 180 days anytime in the year on rolling basis.

1st Jan 2020 - 31st Dec 2020.
2nd Jan 2020 - 1st Jan 2021.

2nd June 2021 - 1st June 2022.

Also, the 3a and 3b as stated above - your answers based on those questions will let you sign accordingly. This is a family consent form generated when you apply and have to submit with the application.

As you bring this (3a), (3b) question up, will you advice what i should answer of the question (3b) ?
My wife(PBS dependent) does not work and totally depend on me financially. Our utility bills are on both her and my name. In this case i understand that (3a) should be answered "YES" but (3b) winding me up!

According to my understating of question (3b), i thought the answer would be "YES" as she depend on me and joint utility bills.

Say yes to 3a and no to 3b because it is regarding a third party which isn't the case in your situation

2nd consent ---> Me/husband.

In my opinion, 3b should be yes. Also, this is a “family consent form” and Part 3 mentions about financial dependence.

I always recommend to sign more than less. No harm.

My suggestion would be:
Part 1: Applicant
Part 2 & 3: You sign.

I have agreed to provide financial support to the applicant as set out in the application form. I have provided information or documentation to support the application. I understand the Home Office may verify the information or documentation which has been provided.

Although PBS dep application does not have any income requirements but financial support could be seen even as you pay her fees or supports her financially and she is not working.

The above is my understanding but since this is a subjective matter, you can decide what you want to do as you have two separate opinions in the thread.

Also, now the new updated PBS dep form asks some new questions like rent etc also. As, I said, PBS dependent does not have any income/financial requirements but since this is a generic form, I suggest to sign more than less.

Hi All,
My Wife(as PBS Dependent) planning to apply for ILR on March'2022.
Please suggest what will be the start date to calculate 5 years route? Is it first BRP issue date or entry clearance date on passport or uk entry date.

** i double checked and dates given below are correct.
Her First BRP Card issue date: 10/04/2016
Entry clearance date on passport(which is for 30 days): 23/04/2016
uk entry date: 07/05/2016

After reading the pdf from gov.uk "Indefinite leave to remain: calculating continuous period in UK Version 20.0" which says

The period between entry clearance being issued and the applicant entering the UK may be counted toward the qualifying period. Any absences between the date of issue and entry to the UK are considered an allowable absence.

So from this reference, it is clearly not the uk entry date. please help me here.

According to my calculation, earliest she can apply(5 years minus 28 days) is 12/03/2022.

She is eligible from 10/4/2021 minus 28 days given she meets all the other requirements.
