Child born in uk applying for british citizenship

Post by Shipporah » Wed Jan 06, 2021 6:12 pm

Hi everyone.

My husband is working in uk with a tier 2 general visa and the 5 year period ends this Oct 2021. We will be applying for ILR in September 2021. I have a 18 months old baby who was born in UK. I can see in the gov website that if the child is born in uk and since the birth, the parents gain a settled status in UK, the child can apply for a british citizenship.

My question is, do we have to apply for ILR for my child also? Or can we apply for citizenship once we get our ILR?

Right now my child is in dependant visa. If we can apply for citizenship directly for the child after we get our ILR, what visa category will the child be in until we apply for citizenship?

Thank you so much in advance x

No.

Yes.

If the visa expires, the child has no status in the UK.

Thanks a lot for your help.

Can the child stay in uk with no status in uk?

Because we will be able to apply for ILR only 28 days before the 5 year period ends. And if we don't apply for ILR for our child along with us, would he be left with no status until we get our ILR and during the application process for citizenship?

Child does not need ilr.

Child does not need a valid visa to be able to register as British as a UK born child has an entitlement to registered. Not having a visa has no impact on the citizenship application.

You will likely have to pay for NHS use once the visa expires.

That makes a lot of sense. Thank you so much for clearing that up.
