Dependent visa application for my wife already here in uk

Post by Ziafin94 » Mon Jan 04, 2021 2:00 pm

Hi,
Thanks for your support. On my ILR your support save my application. I have granted ILR last year. My wife came to the uk as a student. Once my set(0) appeal dismissed I applied as her dependent and granted leave. After that I applied on 10 year route for Ilr and granted. Now my wife's student visa is expiring. I am going to apply for her as my dependent. Please advise me on this regard. Be honest current pandem I can't pay the solicitors fee for the application as I have to pay nhs fee application fees. So I want a guidance from you and a checklist for the application process. Please help me.

When does your spouse's current visa expire?

Do you earn £18,600 per annum? Then apply on Form FLR(M).

Together we are earning around 20,000. I maintain the payslips for last 6 months. Her visa is expiring on 31jan . As i work in restaurants sometimes my employer paid me cash sometimes bank transfer. I mean part of my wages in weekly basis . Is there any problem with that? Thanks for your reply

In some circumstances you cannot apply for, or switch to, a family visa.

Your family member has a work visa or student visa
You cannot apply for a family visa if your family member is in the UK temporarily on a work visa or student visa.

You can apply to stay with them as a dependant instead.

I found this on the link you send. Does it apply to my case . Thanks in advance

You need a minimum of 6 months payslips and bank statements with matching salary/wage deposits.

If you don't bank all your cash wages, they won't be counted.

What you require is evidence of you exact wages reflecting in your account that can reflect on your bank statement and corroborate the payslips from your employer

I can provide employer letter that will state that my employer sometimes paid cash in advance . Last 2 months I received exact amount of my payslip. My wife works for tesco so she received exact amount from them . But my income I couldn't put same amount bcs sometimes I paid cash and I pay my rent in cash . So I spend it . Also my main account doesn't have branch in my area and nearest town as well. If I put this info on my cover letter and my employer letter will it make sense. Please advise me. Thanks

IMHOand candidly it will not. The responsibility lies with applicants to put their affairs in order towards ensuring meeting the requirements not HO bending over backwards to accommodate circumstances that are not exceptional.

I stand to be corrected.

If the cash wages weren't banked in full, they will NOT be counted.
