Hello All,

Please, i am non EU married to EU with a 10 year old son together. We married in Feb 2018 and came to the UK in March 2019 and was given a 5 year BRP-pre-settled status to expire in 2024. My wife keeps threatening me with divorce or leaving with our son to other country. Please, what happens if she leaves or finally made up her mind to divorce me? What can i do in this situation to remain in the UK? Please, im really feeling downcast as i dont really know what to do and kindly need help. Thank you...

You are looking at this:

prior to the initiation of the proceedings for the termination of the marriage or the civil partnership, the marriage or civil partnership had lasted for at least three years and the parties to the marriage or civil partnership had been resident in the UK for a continuous qualifying period of at least one year during its duration

So if your marriage lasted more than 3 years (this is fine for you as you have 10 years marriage) then you stayed 1 year minimum in the UK before the start of the proceedings of divorce, then it's fine. You can apply under retained right of residence later.
