Hi Guys,
My Partner is from India and soon to apply for her ILR but had some questions. Is it:
- SET M Form That Needs Completing?
- Proof Of address that needs to be supplied covering 2.5 years, We have lived at a previous address past 1.5 years then at our current address the last year - Would we provide proof from previous and current addresses? If so, does a covering letter explaining the address change need to be included?
- P60 - My employer has printed this for me. Is original P60 usually just a printed copy? Or should i ask employer for original?
I'm sure i will think of some more questions.

1. Yes.
2. You need 2 years eveidence if cohabitation in both your names, from 3 to 6 different sources, spread evenly for every 3 to 4 months. No need to explain address changes!
3. P60s are NOT required

- My spouse who i am applying for claimed child benefits for a few months until we received a letter from HMRC saying it cannot be claimed in her name.. It was a genuine mistake as we thought it is funds for the child.
Would this affect the application, of course i want to be honest and tell them about this... Would this be asked on the form or should i provide a cover letter explaining this? Or should i NOT mention as they would know?
- Property we live in is owned jointly by me and my brother. I understand that ID document need to be provided as well can this be provisional driving license or if using passport would it be only photo page of passport required?
- As i live in the property with my spouse do i need to provide my ID documents too being the property owner?
- In the letter from property owners would i and my brother state we allow myself and partner to stay in the property and both sign it...
- Do i need to get a document from council showing how many members are able to stay in the property?
- I ordered a statement from water company but at the top it says COPY BILL, would this be acceptable? Or should i ask for original?

28 days before completing the 5 year qualifying period. BRP expiry is irrelevant

My spouse entered on 28 Nov 2015 but BRP expires in March 2021...
I think unintentionally she is an overstayer now... I assumed it was 28 days before BRP.
We have 2 babies together. What would be the best course of action now?
I was going to apply for SET M.

She is NOT an overstayer!!
She can apply no sooner than within 28 days before the 5th anniversary of the date she entered the UK and the latest she can apply is before her current visa expires.
She could have applied for ilr on 1st November 2020 and must apply before X march 2021.

Overstayer ??

She has a valid visa till March 2021. What overstayer ???!
As CR001 pointed out, she was eligible for ILR since Nov 2020. That was the
earliest date she could have applied for ILR but she can apply anytime after that date without any issues as long as her visa is valid. Apply for her ILR now

I just read it wrong after 28 days i thought visa expired phew....
What is the current options in regards to SET M applications? Is it just online applications and post documents?
Can documents be uploaded through an app etc? Or uploaded online etc?

Hi Guys,
Some more questions:
- Proof Of Property Ownership - I am supplying title deeds of property and i have a mortgage statement, although i have just realised this is an annual statement dated 12th Oct 20? Would this be acceptable? If not, What else can i supply as evidence?
- Payslips - When i moved address i didn't update address on payslips straight away I moved around Jan 2020 but Sept 2020 is when the new address is... I only moved next door and that previous address is my parents anyway.

Hi,
If I have online PDF copies of letters and bank statement documents just as I would have received at home address are these acceptable?
Or would I need to get original documents and scan it in?
