Effect of ILR on Tier 2 dependants

Post by qobtan » Mon Feb 15, 2021 10:22 am

I am currently on a Tier 2 visa, and my family as dependants. I am eligible to apply for ILR soon on the 5 year route. However, my family arrived to the UK a few months after I did. If I am successful in getting the ILR, what would my family's situation be?

My understanding is that their Tier 2 Dep. visas remain valid, correct? Or would me getting the ILR invalidate them?

Also, when can they apply for ILR?

Thanks for any help. :)

Their visas remain valid, provided you get ilr based on 5 years tier 2.

They can apply for ilr no sooner than within 28 days before the 5th anniversary of their intiial visa issue date.

Thanks. I should clarify the situation a bit more.

Our Tier 2 BRPs expire in June 2021. I plan to apply for 1 year for all of us.

I qualify for ILR in June 2022. They only qualify by end of 2022. What would happen to them between June 2022 and then?

They would need another extension to reach 5 years to qualify for ilr.

Thanks again for the prompt response. Does that mean it's better I apply for a longer extension this summer (which would be much more expensive), or can they apply in 2022? If the latter, how?

Useful to state what date they got their initial visas issued

If you only apply for one year and you qualify for ILR in July, your dependents will be 2,3 months short so they will need to make another visa application meaning they will have to pay visa fees again so if you apply for a longer visa extension till Sep for yourself and your dependents, you will only pay a bit extra for IHS now but will save visa fees for your dependents which is more affordable. Not sure if PBS dependents can get short extensions like 3 months or so but that will be definitely more expensive.
