PBS Dependant Extension Query

Post by demirider » Tue Feb 16, 2021 9:53 pm

Hi,

My wife has recently received her ILR and I am continuing with the PBS Dependant visa (tier 2) since I don't qualify for ILR yet.
My wife is planning to switch jobs soon - does this mean I will have to switch to a family visa or can I continue staying as a PBS Dependant which was sponsored by her existing employer? (The new employer will not sponsor a Dependant visa).

Any help / advise will be appreciated. Thanks!

You are dependent on your wife, NOT her tier 2 sponsor. Sponsoring employers only sponsor the main visa holder, not dependents.

No issue staying on your current visa route provided your wife got ilr based on 5 years PBS route.

Thanks for the quick response, this is helpful. A followup to that question would be: my current dependant visa would expire in 2 years. After that, if I switch to a family visa, would my dependant visa years count towards ilr?

Not it would not. The 5 year ilr clock will reset to zero. You cannot combine visa categories to make up 5 years for ilr.

Thanks again and sorry if I'm bothering too much but just trying to wrap my head around this, so now given that my partner is a 'settled person', and there's a new Skilled worker visa category that has replaced Tier-2, would I still be able to extend the current PBS-dependant/tier-2 dependant visa after 2 years until I complete my 5 yr requirement?
