County Court Judgement - eventually dismissed - Please Help!

Post by pppjmv » Fri Feb 26, 2021 12:18 pm

Hi everyone,

I was looking for some help regarding what/how to declare the following. I'll summarise as much as possible:

In 2016, I moved to a block of flats that had parking, with parking spots allocated to each flat

After living there for 6 months and using my car daily with no issues, I was away for a week and when I came back I saw I had 4 Penalty Charge Notices.

I removed them, looked up what I needed to do, spoke with the building's concierge, and within the next 3 days I received a further 3 PCNs.

I used a few forums and advice and found out this was part of a scam where they intimidate people hoping they cave in and pay. I didn't.

I moved after 3 months (unrelated reasons)

The company that issued the PCNs sent letters to my previous address, demanding payment. As I didn't pay (in fact, I didn't know I had received the letters), they opened a case in the County Court.

Eventually I even got a County Court Judgement in default.

I wrote up a defence, went to the county court, and the case was very quickly dismissed and I was awarded compensation, with all charges removed, as they deemed I was not in the wrong.

Since this is all cleared up now, should I declare this and, if so, what would be the best way for me to do so?

Thank you everyone!

Declare it as it initially escalated to CCJ. And briefly clarify the same in notes at the end of the form/or cover letter.

It will NOT effect your application.

Upload a copy of court decision also.

Thank you @cullinan!
I will declare it and upload the documents with the decisions.
I am unsure about what date to put though. Should I mention the date the CCJ was issued in default? Or the date it was dismissed?

Thank you!

Hi Cullinan

I will declare this case although I am currently awaiting a confirmation certificate from the county court, so I will wait until I have that before I submit my application.

How about a speeding ticket for which I attended the speed awareness course? No points were deducted from my licence (EU driving licence). Should I declare that?

Thank you!

Hi PPPjmv,

I had the same situation, when I picked up someone on zig zag line near zebra crossing, and police stopped me for that and took my details, but luckily I was just told to attend a course provided by AA for one day, I paid only the course fee for £94 there was no penalty no points by the way.
I did not even declare that in my naturalisation application and I got my approval, and citizenship without any problem.
I hope this will help.

Hi Flamelily2020,

Thank you for your answer, that helps!

Is that a general rule then? If it's a small penalty and I attended the course, I don't even need to declare it?

That's reassuring, thank you!
