Job Loss under New Tier 2 Skilled Worker Visa

Post by b508098048 » Tue Mar 09, 2021 9:24 pm

Dear Community,

Thank you very much for your time!

Are there any policy changes in the event of job loss under Tier 2 Skilled Worker?

The information I have for the old Tier 2 General is that, in the event of job loss, employer requires to report to Home Office within 10 working days. Home Office will send out a visa curtailment letter depending on the case. Normally the new visa expiry date will be cut to 60 days for the individual to find a new job, apply for another visa category, or leave the country.

It will be super helpful to know our rights.

Many thanks in advance!

Curtailment”, in relation to the curtailment of a person’s leave to enter or leave to remain, means cancelling or curtailing their leave such that they will have a shorter period of, or no, leave remaining.

Dear Char,

Massive thanks for your swift response - this is truly helpful!

I didn't see any timeframe in the guidance - assume these actions all depend on Home Office's discretion?

Thanks again!

Cancellation/curtailment letters will likely be sent out quicker at some point and not take the many months they have previously. Plan accordingly.
