Can ILR parent apply for family (child) visa in Uk?

Hello everyone,
I have been in the Uk for 5 years, alongside my children on tier 2 general visa. My children were on Tier 2 dependant visa. I applied for ILR alongside my 3 children. Mum not yet eligible as she is on her own tier 2 general visa as a doctor in training.
I received a call from my UKVI caseworker that the children will not qualify as the Mum does not have ILR and advised I cancel their application and get a refund.
My application was successful for the ILR but my worry is the children’s dependant visa will expire in 2 weeks. Can I apply for family (child) visa for the children?

The broad rule of thumb to remember for children born abroad is that they follow the same immigration pathway as the less-privileged parent and can apply for ILR along with the second parent.

They can register as British citizens after they and both parents have acquired ILR and at least one parent is either applying for British citizenship or has become a British citizen.
