Can ILR absence period be reset?

Post by magnarch » Tue Oct 12, 2021 7:07 pm

Hello,

I have a theoretical question about the ILR. Assuming someone possessing ILR is staying abroad and returns to the UK before the 2 years of absence has passed.

How soon and for how long can one leave the UK again without losing ILR?

The potential options I believe are:
1) after one day the person can leave and can return within 2 years without losing ILR
2) after becoming resident again (>6 months of full-time employment), the person can return within 2 years without losign ILR
3) after 5 years, not leaving the UK for longer than 450 days within those 5 years, the person can apply for ILR again, and then leave for up to 2 years?

Thanks for any answer, especially ones that can direct me to sources - so far I have failed to locate any relevant ones.

ILR under the UK immigration visa route has slightly different absence and loss of ilr rules to settled status under Appendix EU.

Please keep your absence while holding settled status in your existing topic!
