Tier 2 ILR query

Post by silver75 » Wed Oct 06, 2021 8:54 pm

I am a Turkish citizen in Tier 2 and my 5 years will be completing in December 21-January 22. How did you calculate the 28 days before 5 years completion? Which date should be considered for this. Decision of Visa, Visa starting date printed on 1 month vignette, BRP start date or landing into UK? Really confused. Your help is appreciated.

Initial visa vignette start date minus 28 days.

Do not post questions in the timeline only topics please.

How to answer Public Funds Question in Form Set(O)

Post by silver75 » Sat Nov 20, 2021 7:37 pm

Dear board members

I and my 2 dependants are about to complete 5 year route in Tier 2 visa and shall apply ILR shortly. Since I am a Turkish citizen and Turkish citizens can get CB due to exception, I have been receiving Child Benefit since 2017. My question is, should I choose option YES or NO to the question "Are you receiving any public funds?" in SET(O) form ? This is really confusing me. I would be grateful if an expert or an experienced person can reply?

You must answer all questions truthfully otherwise you may be accused of deception. The answer to the question whether you are in receipt of public funds is clearly YES. Child benefit is a public fund but the HO know about the exception for Turkish citizens.

Many thanks Manci. I was thinking the same and would be appropriate. Is there a section where I can note this in the application form so that the caseworker won't miss this exception? Regards.

Dependent absences

Post by silver75 » Fri Dec 10, 2021 7:25 pm

Dear board members and moderators,

I please need your immediate help. As a family applying to ILR through 5 years Tier 2 route. We entered UK in 24/01/2017. The online application form asks this question:

Does the period of stay on which this application was based include any leave granted since 11 January 2018 for my spouse. When I answer NO to this question the form does not ask us to list her absences. But I know that 180 days continious residence limit applies to her after 2018. Am I misunderstanding this queston? What should be the right answer? Any help appreciated.

The absence limit only applies to visa granted after 11 January 2018. If your spouse has only one visa from 2017 then you should select NO

Dear moderator, sorry for the wording!

My wife, myself and my son all have the same date of visa issued: 16 January 2017 and our visas are valid until 22/02/2022. Thanks very much for all your support.

Then there is no absence declaration required for dependents if you all got a 5 year visa.

The absence declaration is only required if an extension or initial visa was issued on or after 11 January 2018.

Police Registeration form for Dependant

Post by silver75 » Tue Dec 14, 2021 1:51 pm

Hi board members

I am filling the ILR application form SET(O) which would enable us to apply ILR through 5 years TIER 2 (General) pathway. The form listed the documents for submission along with the application. It listed Police registeration for the main applicant but not for my spouse. Is this correct? What would be the reason for this. We are all from Turkey whose nationals require to register police in 7 days. Thanks

The list is not always accurate. You both must provide it

Old IELTS General TrainingTest Score

Post by silver75 » Sun Dec 19, 2021 11:22 am

Dear board member; I am about to apply ILR but I have a problem. I have an old IELTS General Training test score which I obtained in 2016 and used for Tier 2 application. Can I use this? Test provider is in the list but the test is not seen in the Excel spreadsheet. Can moderators or experienced members advise? I please need an urgent response?
