Query regarding cool off period and applying for fresh UK work visa

Dear Members

I have been travelling to UK on work permit (tier 2 ICT visa) from my company. Here is the summary of my last 5 years Visas

First- short term Tier 2 ICT Visa from April 2016 to April 2017
Second - long term Tier 2 ICT Visa from December 2017 to December 2019
Third - extension on previous long term Visa from December 2019 to December 2021

However due to personal reasons I traveled back to India in January 2021 and never went back to UK.
And now I am again getting an opportunity for UK but the immigration advisor in my company is saying that since I got UK work visa in last 5 years, hence I need to serve cool off period for 1 year to get a fresh work visa for Long term.

Can I get your advises on the below points:
1. will the immigration consider both Short term and long term visa duration to calculate 5 years cap or just the Long term visa duration to applu for fresh work Visa
2. Is the cool off period still applicable as since last 2 years I am in India As i was in India since January 2021
