British Citizenship requirement

Post by ustron20 » Wed Feb 09, 2022 9:41 pm

Hello ,

I am seeking your advise please :

I am holding ILR under EU settlement Scheme and I have Settlement Status since February 2019 and permanent resident card since April 2018 , I have passed life in UK exam and I have obtained the ISOL certificate from Trinity Colleague and I never commit any conviction .

In September 2019 I travelled abroad for 3 months however I had a difficult family situation and I was need to stay , than COVID pandemic and travel many restrictions makes my travel to UK difficult .

I planned to go back to UK in 2 weeks time , I did called the home office on the phone and they checked my status and they said is valid and all fine , they told me also I can spent up to 5 years on row outside UK .

Question :
Because I been outside of UK for 2 years and four month and also because of genuine reasons as I mentioned before , can I apply for British citizenship after all ? As by law I can stay 5 years on row outside UK when I am holding EU settlement ILR
" If you want to spend time outside the UK
If you have settled status, you can spend up to 5 years in a row outside the UK, the Channel Islands or the Isle of Man without losing your status "
Apply to the EU Settlement Scheme (settled and pre ... - GOV.UKhttps://www.gov.uk › settled-status-eu-citizens-familie

Thanks a lots for advise

This is only relevant to the EU settled scheme. Best not to confuse the more generous settled status absence rules with the citizenship rules.

Naturalisation has its own requirements and laws, including a strict absence limit if no more than 450 days absence in the 5 years immediately preceding the date of application and no more than 90 days absence in the 12 months immediately preceding the application date.
