P60 for ILR

Hi,

I have gone through some posts here and am curious as tier 2 visa has now been changed to skilled visa and am not sure of how dates for ILR are calculated. 

If the way I am calculating (guided from some poste here) is correct, then its a big financial mess I am looking at in future.

My date of Entry clearance is - 08/11/2017 (Tier 2 General Visa )
2 dependents on Tier 2 dependant visa
Date of entry in UK - 30/11/2017
Visa expires on - 09/10/2022

If I calculate 28 days from the date of entry clearance, then earliest I can apply for ILR is 12 -13 oct 2022, which means that since my visa will expire on 09 oct and I have to apply for an extension of visa for all 3 of us to keep us legally in UK on 12-13 oct 22. 
For 3 of us, the extension of visa (3 years) will cost me approx 8000 £ (NHS surcharge etc included).

And then I have to apply for ILR later, which will be another £8000-9000.

Is there a way to avoid the extension of visa cost/application? Can I apply for ILR  28 days before the expiry of visa (not the entry clearance dae) ? (but I won't have finished 5 years then)?

Is this a common situation or am I the unlucky one here?

Pl advise. I am hoping that my calculation is wrong or I have missed something in rules. What is teh best option for me? Thanks.

Digging more on this forum, I think I realize now why this has happened.

My CoS mentions the date of expiry of contract as 25 Sep 22.

When I first applied for Visa (in Aug 2017), it got delayed by 80 + days (no error of mine or office). I finally got the visa in Oct 17.

I was originally supposed to come to UK in Aug/Sep 2017 but ended up coming in Nov 17.

But in the CoS, dates reamined the same as it could not be changed.

Can anything be done now? Basically if I get one extra week on my current visa, I can apply for ILR.

Will HR writing to home office, about this issue help? Any other past posts here that you can pl refer me to ?

But if I apply before visa expiry, I wont have completed 5 years from the date of entry clearance on the day of application.

Will I be eligible to apply for ILR? Wont they reject it ?

It's fine, many do this. As long as you are eligible on the date of decision.

I am not able to understand your comment when you say “when you are within the 28 days period.”

My visa expires on – 09/10/22
My 5 years stay from date of entry clearance is – 08/11/22 (that means my 28 days prior start on 11/10/22)

If I do the following should I be fine –

Apply for ILR online on 07/10/22 (since visa expires on 09/10/22)
Upload documents by 15/10/22 (that will be within 28 days of 5 yrs. Period – 28days)
Book Biometrics by 15/10 to 30/10/22

If I use priority service, will it go aginst my case, since I am already applying at a earlier date.

My visa expires in Oct 2022, which means that I have to apply for ILR before that (even though I dont finish 28 days before... requiement).

My COS expires in last week of sep. Does it mean that I have to apply for ILR before the expiry of the COS ? Or it doesnt matter?

Employer is willing to issue another COS. So, when should I get that ideally ? Can you please point me to a previous query / sticky where it has been anwered. I can refer to that.

COS is only issue during extension, no need for a new COS

So old passport expired on 03/01/2022 whereas the new one issued starts from 05/01/22.

Will that affect my ILR application (which I will submit later this year) ? Do I need to add some documents or fill in an additional form for 2 days gap in my pasport?

Hi,
I posted this earlier too (months back). But now as I am approaching the date and documentation process, I am getting nervous.

Date of my Tier 2 visa expiry – 9 oct 22

Earliest that I can apply (i.e. within 28 days) – 11 Oct 22 (as visa issued on 08/11/2017)

Should I apply on 7 Oct (i.e. 31 days before the eligibility or 5 years qualifying period) and then book biometrics somewhere on 15 Oct ??

A few links posted here (of Oxford and Cambridge universities) say that if you apply early, application is ‘automatically rejected’.

My HR is saying to get a ‘visa extension’, which means I have to pay a lot. Should I go for visa extension and then apply for ILR (as a safe and expensive option).

Or am unnecessarily worrying and this is a routine question.

Is there a way my HR can ask home office for advise ? Or no such option exists.

I suggest you to take solicitor’s help in your case. 28 days before visa expiry is mandatory for ILR application. If you apply before it, your ILR application can be rejected.

ILR is granted as the day of the decision is used. Why does the OP need the help of a solicitor ??

Hi all,

I am preparing ILR application now. My visa expires 2 days before the (5 years minus 28 days period). I have been advised to apply close to the visa expiry and then take a biometrics appointment within 28 days period. So that is my plan. However, I want to apply for priority / superpriorty due to family constraints. I have seen many posts here that people are not able to get priority slots even after trying for 15-20 days. So my query is how early can I apply for ILR (that will give me enough time to look for the priority slots)

Is it Ok to apply 15 days earlier than (5 years - 28 days period). that will give me 15 days to look for priority slots. Any advise ?

I can't find P60 for 2018. I do have from 2019 to 2022.

Do I have to ask my employer (I haven't changed employer in these years).

Or it is not needed?
