The immigration rules clearly state that both parents need to be applying at the same time, GR12.2. also important to note that if the spouse is not in the UK to apply at the same time as OP, he cannot apply later from abroad as a graduate dependent.lolo2 wrote: ↑Thu Feb 17, 2022 4:16 pmThis is a completely different scenario than the original post.
The Graduate can apply with or without their dependents (partner or children). See page 21: Graduate route The guidance does not mention anything about one of the parents not applying at the same time, but I think it should be fine.
By the way, this scheme is called Graduate Route, there's no such thing as a PSW visa... not sure why some people, universities and solicitors decided to call it like that.
The official documents don't mention "PSW visa" anywhere.
GR 12.2. Each of the applicant’s parents must either be applying at the same time as the applicant, or have permission to be in the UK (other than as a visitor) unless:
(a) the parent with permission as a Student or Graduate or as the partner of a Student or Graduate is the sole surviving parent; or
(b) the parent with permission as a Student or Graduate or as the partner of a Student or Graduate has sole responsibility for the child’s upbringing; or
(c) the decision maker is satisfied that there are serious and compelling reasons to grant the child permission to stay with the parent who is applying for permission as a Graduate or as partner of a Graduate.
Page 21 of the guidance refers you to Appendix Graduate, where you need to urgently read paragraph GR 12.2.
