Looking for help to understand my ILR eligibility

Post by happyhappy987 » Thu Feb 03, 2022 1:56 am

ILR visa combination clarification:

Current status:

Global talent tier 1 - exceptional talent promise route from arts council, and the ILR route is after 5 years.

( Was holding Representative of an Overseas Business visa for one year before switching to Tier 1 Global Talent)

Upon checking the “Check if you can get indefinite leave to remain “ page, it stated that the 5 years times in the UK requirement visa combination does include “ Representative of an Overseas Business “.

However, when my immigration lawyer and myself read the immigration rules page, it did not mention “ Representative of an Overseas Business”; below is a quote from the page:

“ GT 11.3. The continuous period must consist of time with permission on any of (or any combination of) the following routes:
(a) Global Talent; or
(b) Innovator; or
(c) Skilled Worker; or
(d) T2 Minister of Religion; or
(e) T2 Sportsperson; or
(f) Tier 1 Migrant, other than Tier 1 (Graduate Entrepreneur). “

The Global Talent version 6.0 doesn’t mention this too.

I called the UKVI number provided online, and the lady in the phone she can’t help with this; emailed them they say they can’t give advice; ask my professional reputable immigration lawyer, she also said the both website pages don’t seem match too. Would be appreciate if I can have some support here .

Thank you! ❤️

As per immigration rules, time spent under Representative of an Overseas Business visa does not count under the Global Talent visa route to ILR.

Please note that the Global talent visa is not a Tier 1 visa :!:
