Married to British/EU Citizen

Post by Richie85 » Wed Mar 02, 2022 3:45 pm

Hi everyone,

I'm really confused about something. My wife is an EU/British Citizen and I'm starting to believe that I can get Settle Status instead of Pre Settled Status. Is this true or am I mistaken?

I'm on Pre Settled Status right now and my family and I have an opportunity to do some charity work overseas but I can't with my pre settled status requirements.

Any advice is welcome.

Hi Everyone,

I forgot to add that my wife and I got married in Nov 2019 and she has been a British citizen for the last 6 years as well and before that she was an EU citizen.

I got my pre settled in Jan 2020 however I'm starting to think that I got the wrong status.

I'm canadian btw

My understanding is that you need 5 years residence as an EU family member before you can apply for settled status.

If you got married in 2019 then you have only completed two years and three months as a family member of EU national. You need 5 years, as CR001 points out. What makes you think you need less? Nationality is irrelevant unless you are a EU national yourself applying on your own right.
