Post by praveenkakkerla » Wed Feb 23, 2022 10:25 am

Hi I have British Passport and my child has ILR (issued on july 2020)and he is 5 years old.
He spent 8 months in another country in last year.
Can I apply naturalisation for him now if yes can you please send me which application form need to be used.
OR
DO I need to wait for 12 moths before I apply naturalisation as it requires 12 months stay in UK on ILR before apply.

Please advise.

Thanks

Was the child born in the UK or outside? What is the UK immigration status of the other parent?

Children born outside the UK can apply to register as a British citizen when one parent is a British citizen and the other at least has ILR.

Thank you for your reply,
Children born outside UK.
Other parent is on ILR.
And child is on ILR.
Only question is he spent 8 months in another country last year.
Does he need to wait 12 months to apply citizenship .
Or 12 month stay rules doesn’t apply to kids??

Children don't have absence limits.

No need to wait 12 months

Thank you very much for your reply.

When filling the application form, I have answered below questions like this

Have you passed the Life in the UK test? No

Are you claiming exemption from this requirement
because a physical or other condition prevents you
from taking the Life in the UK test or doing a
speaking and listening qualification in English? NO

Did you meet the knowledge of English
requirement as part of an indefinite leave
application made on or after 28 October 2013? Yes

Do you have a degree that was taught in English? No

Have you passed an approved English language
test? NO

Are you claiming an exemption from the English
language test due to a medical or mental
condition? NO

Do you meet these residence requirements? Yes ( though he doesn't satisfy the 12 Month stay rule mentioned)

I wasn't expecting LIfe in UK and english language requirements in child Application form.
Am I filling correct application? if yes are these answers correct?

Please confirm

Which application are you filling in?
For children it's MN1 - your queries suggest you are filling in AN adult naturalisation??

Under 18s are registered - adults are naturalised:

Hi Can you please let me know which option I should choose for below question?
Child born outside UK.
One parent has UK passport via ILR route
Other parent is on ILR.
And child is on ILR.

Choose which category to apply under. You are a child under 18 and:
born outside the UK

Your parent is British by descent and lived in the UK or a British Overseas territory for at least 3 years before you were born

Your parent is British by descent and you and your parents (unless they are legally separated) are now living in the UK or a British Overseas territory

You were born on or after 13 January 2010 and your parent was serving in the UK armed forces

You were adopted abroad by British citizen parents

You were born before 1 July 2006 to a British father and your parents were not married

One or both of your parents is applying for British citizenship

Other - apply at the discretion of the Home Secretary

Thank you for your reply
I have been asked below question even after selecting other option

Provide details of your grandparent from whom your mother or father derived British citizenship by descent.

Grandparent details

Can I select, I do not know these details for this?
