Naturalisation for - Set (M) Granted on a 5 year Route

Post by am28 » Thu Apr 07, 2022 10:23 am

Hi All,

So I got my SET (M) granted last week. My timeline is as follows:

Entered UK: 02/04/2017
FLR (M) extension: (Issued:18/12/2019) & (Valid Until:16/07/2022)
SET (M) ILR: (Issued: 30/03/2022) & (Valid Until: 31/12/2024)

5 year route

Questions:

1. My wife has been a British citizenship since March-2021. She did that through ILR route too. Can I apply for naturalisation on the basis of:
a.) ILR AND
b.) Wife is British citizen so no need to wait 12 months after ILR?

2. If I apply and whilst my application is in process, can I travel on my other passport, as I remember with ILR you're not supposed to leave the country as the application becomes invalid and rejected. Is it the same case with Naturalisation too?

1. Yes, if you meet all the standard requirements.

2. You are free to travel. Citizenship is not an immigration application and has different rules to the visa and ILR applications.

Thank you, anything/any point in particular I should be careful about otherwise?

I know of one thing that is, to be in the UK physical exactly 3 years before the application submission date.

Please be aware that "exactly 3 years" is tricky to calculate. You are supposed to go back 5 or 3 years, depending on your case, AND add one day. Best practice is to allow a few days either side, to make sure the selected day meets the requirement.

See this post and this post, where some members encountered issues because of this calculation.
My posts express what I believe are the facts, based on the best of my knowledge, about the topics discussed in this forum. They do not constitute immigration advice.

Thank you. I did leave a few days either side.
