Visa for Family members

Post by moh1991 » Tue May 03, 2022 12:11 pm

Hi Team,

I have one query regarding visa for family members.

I came to UK in October 2010 as main applicant on Tier 2 ICT Visa(Established Staff). My dependant came to UK in 2014 and had one year break from 2016 to 2017.

I got ILR last year on 10 year route (Long residence).

My query is around whether my dependant can apply for ILR this year on 5 year route. Someone said that dependants can go for ILR even after 5 years. Please confirm if this is the case.

No they cannot. As you got ILR based on 10 years long residence, your dependents must switch to FLR(M) visa (x 2) for 5 years before they can apply for ILR or 10 years long residence if she qualifies for that sooner.

Someone told you incorrect information. They cannot apply for ILR based on PBS Dependent visas.
