Immigration from Hong Kong

Post by Ayazur » Thu Jun 02, 2022 4:56 pm

I was granted British Citizenship from BNO back in 2014.
My Daughter 12 yrs now, was born after I was granted British Citizen
My Son 7 years now, was born after I was granted British Citizen.
I had always been in Hong Kong until last year when I decided to move to the UK for my son who is autistic and is not getting the English-based treatment for his autism.

I have been in the UK for 6 months now and managed to find permanent employment surpassing the 24800 requirement. SO far I have been with them for over 3 months. Do not have any criminal records. Did not ever apply for any form of benefits nor do i intend to.

My question is what's the best way to apply for my family members to move to the UK permanently?

I have applied spouse visa for my wife.
Should I apply for a family visa for my daughter and son?
I also have my mother 66 years old who has always been living with us moving and with me. We look after her daily chores like cleaning and cooking. She does not have any serious health issues apart from hypertension. She assists in helping look after our autistic child who requires constant supervision.
How should i approach my mother's application?

Any advice will be greatly appreciated.

Thanks

your son is probably automatically British and if so can apply for a British passport

Going by your description it is very unlikely that your mother would be eligible for a visa on the Adult Dependant Relative route.

Is she not eligible to apply on the HK BNO route in her own right?

Hi manci, Thanks for the reply

I did get naturalized after my daughter was born, but before my son was born. I have only spent 6 months in the UK so far. Does it affect my son's direct British application to get him British directly if I have been in the UK for less than 3 years?

My mother doesn't have BNO, we all carry Hong Kong passports. I understand UK has an impossible to meet adult dependant visa requirement. But we do want to see if we can try as my heavily autistic son is in need of 24hours care. Instead of a carer, we would like family to help assist in looking after him. ANy other carer visas maybe?

As of February 2022 carers (SOC code 6145) have been recognised as a skilled as well as a shortage occupation and as such are eligible for a work visa. However a licenced sponsor is needed for the sponsorship. You as a private individual cannot sponsor under this route unless you are a sole trader sponsoring the individual to work for your business.

Thanks, Manci,
I guess my only option is to go ahead and start a spouse visa and dependant visa for my children. The NHS surcharge and application fee is ridiculous but no choice.

Have to take a gamble with the adult dependant visa.

Have to take a gamble with the adult dependant visa.
Be careful though, as if it is refused (which is highly likely), it shuts the door to entering the UK as a visitor in the future.
