German girlfriend

Post by Goodlaugh » Sun May 29, 2022 5:59 pm

Hi, I have a German girlfriend. As we see it, she can come to the UK to visit me for only 6 months in a year. Getting a 'family' visa is also only for 6 months.
Does anyone know if there's another visa we can look at that's longer?
Also, just some back info, she use to live & work here for 7 years until the year 2000. Would this have any sway in getting any kind of visa that she has an NI number? Also, some info that might help, she's helping me (as a carer) looking after my 98 year old mother.

Any help or advice would be greatly appreciated. 🙏

Please be aware that she is not permitted to do any form of work, paid or unpaid, while in the UK as a visitor. She would be in breach if her visitor visa conditions. Being a carer is considered work

Ok thank you. When I say she's "helping me" she's only cooking meals and helping me with chores. I was just wondering if there was some kind of visa that would allow her to stay longer, I'm the carer

has an NI number?
Note that NI numbers are never deleted (or re-issued to someone else) as far as I know. And it would be no help at all.
Options:
- Fiance visa, she comes to the UK to get married and then leaves and you apply for a spouse visa for her, if you can satisfy the financial requirements.
- Or you get married in Germany, then apply for for spouse visa from the UK, again need to satisfy financial requirements.
Note in these circumstances she can't come to the UK whilst a visa application is being processed.
The post-Brexit immigration system makes it now difficult for EU citizen to come to the UK permanently (just like any other foreigner now). The system is not geared towards making it easy for people to move around (compared to EU free movement).
This is just my opinion as a member of this forum and does not constitute immigration advice.

She does not have to leave the UK to apply for a spouse visa if she comes on a fiance visa.

You are confusing the more expensive fiance visa with cheaper marriage visitor visa.

What was the most recent period before 31st December 2020 that she was resident in the UK? And how long has she been absent from the UK for?

Ok, thank you, (so far) 🤣 so, another question then, linked, but was in our plans down the line.
We were going to get married in Denmark or Germany, because, once mother passes away we want to live in Spain, and I can do this as a Brit, by marrying an EU citizen, ill have no visa issues this way.
So, my other question is, if we got married here in the UK, can I assume, that the above won't be true, and we then, can't live in Spain.
Sorry for all the questions, life was so much easier before Brexit.

Where you get married is irrelevant to the EU rights if a spouse of an EU citizen moving to an EU country.

Oh, so we can get married in the UK, and I can still move to Spain with her, with no restrictions?
But, even if we do get married here, it still only means a 6 month stay on a visa?

She left January 2000, she's been away 22 years.

But, even if we do get married here, it still only means a 6 month stay on a visa?A visit visa is a visit visa. It doesn't matter if your spouse is British, settled, student or just a general worker here. You'll only be permitted 6 months max! If you want to stay longer, then you need a settlement visa! Same way a Brit would be allowed 90 days in 180 days max if you go to the EU. You need to apply for the right paperwork to stay longer. The law is the law.

German girlfriend

Post by Goodlaugh » Sat Jun 04, 2022 6:04 pm

Hi, can anyone help us, please. My girlfriend is from Germany. We are looking into the Visa situation and which is the best one for us, to get her here for longer than 6 months. At the moment, she just comes & goes as and when. But, we know we're getting near our 6 month threshold.

(Just to add) long term, we intended, to get married probably in Denmark, then live in Spain. (Not that I think it matters) but she did live & work here for 7 years, until 2000.

The whole visa situation is a minefield to us. Can anyone help us, with which they think is the best for us, to allow her to be here, for longer than 6 months.

Your only options are a partner visa or if she can get a skilled worker visa sponsored by an employer.

There is no general visa allowing her to stay long term as a visitor

We looked into the partner visa, but it's saying we have to prove we've been together for 2 years...but we haven't.

This 2 year living together would not be required if you were married.

Ok, so we have all the papers we need to get married.

So, lets say, we get married. What do we then need to do as far as visa's are required? And which visa. And, barring in mind she's German, and we get married in the UK, would I still be allowed to live in Spain as I'll be married to an EU citizen. 🙏

So, lets say, we get married. What do we then need to do as far as visa's are required? And which visa.

A 6 month fiance visa if you want to marry in the UK, visa costs around £1500 and must be applied from abroad. Once in the UK and married within the 6 months, she applies for a spouse visa within the UK, which costs around £1033 plus £1560 immigration health surcharge. The spouse visa will be a 2.5 year visa

If you marry abroad, then apply for a spouse visa, which costs about £1500 plus the immigration health surcharge of about £1700. This will be a 2.5 year visa.
And, barring in mind she's German, and we get married in the UK, would I still be allowed to live in Spain as I'll be married to an EU citizen. 🙏
I already answered this previously!!
