Hello.
I know the rule states you cannot travel while you have a pending application for ILR however we have a family emergency and need to travel and there is no answer on the paid helpline.
My question is has anybody had their application withdrawn due to travel? I know thats what thenrule states but please reply only if you have actually had it withdrawn. Thanks

The rules are clear that they will. It is up to you to risk this.

When does the spouse visa expire?
Has Biometrics submission been completed?
Note that you lose your fee paid if it is withdrawn.

The spouse visa expired in May already.
Biometrics done in May also.
It has really taken its time and i dont understand if they will consider an emergency.

If your spouse visa is already expired, apart from the ILR application (which would be withdrawn), how do you plan on re-entering the UK?
No sin in failing, you just have to try and try again!

Travelling is
risky. Instead, try the
following to expedite the decision:
- Contact the Home Office, preferably in writing. You should include the following information in your letter/email:
- Your full name, date of birth, nationality.
- Your current address.
- The Home Office reference number.
- Type of application you submitted.
- The date the application was submitted.
- When you expected the decision to have been made by in accordance to the Home Office timeframe.
- Give dates of any previous chase up letters sent to the Home Office.
- Most importantly, the effect of the delay in considering your application is having on you and/or your family.
- Contact your local MP. It is essential that you provide all the information related to your case so that your MP can make the appropriate enquiry.
Explain the emergency. Ask for a quick decision on compassionate grounds.
