Concern regarding nationality for British passport.

Post by Isaiah-2000 » Thu Aug 04, 2022 7:19 am

Hello

I have an inquiry in regards to obtaining a British passport/confirming citizenship, I intend to do it by proving that my mother was a citizen of a EU country (France) who had free movement rights in UK at the time of my birth, however I'm not sure what I would need to provide to prove this.

Kind regards

I'm curious. What makes you think that being the child of a EU citizen makes you eligible for British citizenship?

Previous free movement rights alone won't do it, else, pretty much every EU citizen would be eligible, which isn't the case.

To be eligible for British citizenship, you first need to have indefinite leave to remain or Settled Status. Do you have any of these?

The OP was born in the UK, this is not required if under 18 and parental was settled.

If OP qualifies it would depend on what the EU citizens status was at the time of their birth, ie PR or no PR and when the OP was born, before PR or after PR of parent or at least 5 provable years of exercising treaty rights.

If OP is over 18, it changes thing slightly depending on the above answers.

I see. Could be inferred, but not actually said. OP to confirm.

Thanks for the speedy response, apologies for lack of detail in the OP.

I was born in the UK between Jan 1983 - Oct 2000 and have never left since.

My mother would be a good candidate for this but it's just in regards to the second point where I'm unsure which documents I need to provide to prove it.

If your mother was exercising treaty rights at the time she must have been either
- a worker
- a student
- self-employed
- self sufficient

In what category did she fall when you were born? Depending on that you can source the right evidence.
