Indefinite Leave to Remain

Hi, my question is about my mother applying for ILR or Extend family visa,
She came on spouse visa on 10.11.12 on a 5 years route, my father is a
British citizen, my mother is not able to do LITUK or English test she has
been extending visas every 2.5 years. Her next extension is Due in
September but as of now she is over 65 which means she is exempt from
English tests. My question is should we apply for ILR or extend her family
visa for another 2.5 years? She will also complete 10 years in the UK on
10.11.22. Please need proper advice guidance. As her extension is due on
15.09.22.

Update: The ten-year partner/parent ILR form is probably not SET(M).

I believe the OP is applying under the 5 year route, not the 10 year route

Good point. I agree if she had successfully extended on FLR(M) each time, then she is currently still on the 5-year route.

The initial post was unclear on which English test she had previously failed. If she was unable to pass at least an A2 English test since 1st May 2017 and was not exempt from it, then they may have placed her on the ten year route? Then, her 5 year leave may not have been continuous?

But if she had applied for SET(M) since after 1st May 2017, each time previously, then they may kept her on the 5 year path under D-ILRP.1.2., without her having to apply for FLR(M), that had included the A2 English requirement?

We extended her visa every 2.5 years due to LITUK and English test she couldn't do. Now she hasn't completed the 10 years route but she is over 65 which means she is exempt from English tests. 10.11.12 to 10.11.22 thats her 10 years route in the UK to apply for ILR. He next extension is due on 15.09.22. We used to apply for 2.5 years visa on FLR family route as a partner of a British citizen. Before we spend so much money on her ILR or family route 2.5 years application we want to be sure as we don't want to lose our fee and get refusal. The solicitors I spoke to didn't give me a proper answer. Please need your proper help as my father is a pensioner himself. Thank you
