English & marriage certificate

My husband is looking to apply for British citizenship, got couple of questions and appreciate if you could help with answering:-

1- He passed B1 test in Jan 2020 which was used for FLR(M) application, it was then used again for ILR (even though the certificate had expired when the ILR application was submitted). Can he use the same certificate again for the naturalisation application?

2- For the marriage certificate, we got married abroad, is it ok to submit a non-uk marriage certificate or we have to register marriage in the UK?

1. Yes - can be used for naturalisation.
2. There's no requirement to register a foreign marriage in the UK if the marriage is legal in the country it was performed.

1. Okay.
2. If necessary, then submit same evidence of marriage as for the spouse visa?

We are planning to submit naturalisation application shortly. Just couple of last min questions please:-

1-My husband obtained ILR on 1st Aug 20200. Since I hold british citizenship, he can apply now and doesnt need to wait 12 months yes?

2-How is it determined on the application that it is 3yr rather than 5 yr route? we have completed the application and it says type of application is "Apply for naturalisation as a British Citizen" and doesnt mention anything spouse citizenship. Is this OK?

3-Shall we put absences outside the UK for the period of 3 yrs or 5yrs?

1. Correct - can apply now.
2. You just provide the details and data for three years, and include spouse passport/marriage evidence. Caseworkers know the rules.
3. 3 years' absences.

Consent and previous passport

Thanks alterhase58, really appreciated.

We have submitted the application, it is asking for a consent:-

1- I see part 1 needs applicant signing which is fine.

2- Who needs to sign part 2? Do referees need to sign it or just the spouse?

3- Is part3 (3rd party sponsor) required to be signed?

4- On a different note, do we need to submit both expired and current passport of applicant? The absences in the last 3 years are covered by the current passport. However since we put the "first arrive in the UK" date as 7 July 2017, it is better to supply previous passport too?

Just confused as don't remember it asking for consent when we applied for ILR.
