late submission for spouse visa extension will this effect ILR

Hi All

I was suppose to apply for my spouse visa extension on the 12th April 2020, because of Covid the visa was submitted on the 12th July 2020. we received the visa extension on the 6th Oct 2020

Will this effect when we apply for ILR ?

Or do we continue and complete the 5 years route then apply for ILR this Oct 2022?

because of Covid the visa was submitted on the 12th July 2020.

The key questions is, did you apply, submit and pay online BEFORE your last visa expired?

Why did you not submit and pay online before your visa expired?

What was the expiry date of your last visa??

What did the UKVI approval letter state when the visa extension was granted? It is possible that you were put on the 10 year partner route?

Time spent in the UK unlawfully, does not count towards ILR.

Covid had shut down everything, we phoned UKVI, and they told us that the centres were shut down. That's why we submitted late.

The expiry date was 21 April 2020

UKVI approved the visa extension, but there's nothing mention about 10 years partner route. just 5 years route

The online submission was not affected by COVID and you should have applied online before your visa expired. The Biometric appointment is not the application date and the appointment date can be after visa expiry.
The expiry date was 21 April 2020

So you applied months late.
UKVI approved the visa extension, but there's nothing mention about 10 years partner route. just 5 years route
Does the letter state under what immigration rules the extension was granted??

You should submit a Subject Access Request to understand but a period of no valid leave will affect ILR and British citizenship.

in the letter we were granted a period of 30 months limited leave to remain under paragraph D-LTRP1.1. of Appendix FM to the Immigration Rules as we are satisfied that you meet the requirements of
paragraphs R-LTRP.1.1 (a), (b) and (c) of these Rules.

Correction, I applied on the 21 July 2020 after 33 months in the UK. we didn't miss the expire date .

Was the 21st July 2020 the expiry date stated on the BRP card? Really important to post the correct information.

Good afternoon,

I have applied for my wife ILR application last month and we went to the UKVCAS appointment on Friday the 4th November 2022. We were supposed to get an answer by Monday the 7th November 2022 as I paid for the Super Priority Service. My wife received an email stating that they could not process in 1 day as my application raises exceptionally complex issues. I would like to know what happened, if they need any further documents as I thought that my application was straightforward.

What is this exceptionally complex issues?

Please advise

Now you might have to wait. It could be as long as 6 months or more, but you just have to wait now.
No sin in failing, you just have to try and try again!
