Applying British Citizenship after getting ILR on 10 year route

Post by Reema1 » Tue Sep 13, 2022 1:55 am

Hi
I need help. I came as a student with my husband as a dependent. In 2017 my husband got ILR and got British citizenship in 2018. In 2017 I switch to 5 year spouse route. I applied for 2.5 years spouse visa and than extended my visa for another 2.5 years. Before this extended 2.5 years end My 10 years of legal stay was completed and I applied for ILR on 10 year this year 2022. Now do I need to wait for 12 months to apply British Citizenship because I got ILR on 10 year route or I can apply for British Citizenship straight away because my husband is already British citizen.
Does the route of getting ILR effects the British citizenship or it does not matter because when I got ILR my husband was already British Citizenship. Its been 4 months I have got ILR. Shall I apply for British citizen or wait for 12 months.
Thank you in advance

The route to ILR is irrelevant for the purposes of Section 6(2).

As spouse of a British citizen you can apply immediately after gaining ILR - no waiting time required. Route to ILR is irrelevant.

Hi
I submitted my naturalisation application on 5th of october 2022. When I tried to book my appointment for boimetric it was showing that Homeoffice is accessing if I can use IDV application for reuse of my biometric.it took around 8 days to show that I can use IDV app and no need to book an appointment. In the meantime I had an emgerncy to travel back to my home country. If i submit my documents on IDV today on 27th october than exactly 3 years back on 27 october i was not in the UK. I want to know when exactly the date will be considered. Do i need to see my presence 3 years back on 5th October or on 27th October. When do the application date the case worker will consider??
Also is it okay to submit the documents on IDV application when I am abroad or I should be in UK when I submit the documents.

Date of application that is relevant is the date you submitted and paid online and not biometric submission date.
