ILR Application for dependent child and English requirements for main applicant.

My husband is due to apply for indefinite leave to remain and would like to include our children in the application. He is on a Tier 2 skilled worker visa and i am also on a Tier 2 visa (but not yet eligible for ILR). We have two children, one born in the UK and one outside. My question is can both my children apply at the same time as husband?. The other question is husband has a degree with a UK university, can he use it as proof of English test?

SW 39.4. may prevent the children from apply for ILR when only one parent is applying for ILR.

Your husband may use a UK degree to satisfy an English Language requirement. However, there is no English language requirement for the Main Skilled Worker’s ILR, although adult dependants do have an English Language requirement for ILR.

There is a KoL requirement.

The child born in the UK doesn't need to apply for ILR. You can naturalise him/her when your husband gets his ILR.
