Stamp 1 (CSEP) to Stamp 4

Post by Brades » Thu Oct 06, 2022 2:33 pm

Hi All,

I'm just short of a month away from my Employment Permit expiring and I've noticed that the DBEI is 2 months behind on providing support letters for Stamp 4. Also my IRP is expiring on the same day.

My questions are:
1) Am I able to continue working AND apply for an IRP renewal while I wait for my support letter?
2) Am I able to just apply generally for an IRP renewal on stamp 1 without the support letter?

Incidentally I got married a few months back to my Irish wife and I noticed that it says it will take over 12 months for a change to Stamp 4 there, I assume I can't work unless I get the support letter?

You cannot renew your IRP card unless you either have a new work permit or you have a support letter to change it to Stamp 4.

You should be able to apply for a support letter 3 months before your work permit expires. Why did you wait till the final month?

If you want to get a Stamp 4 based on your Irish spouse, you can do it right away. There is no waiting time and it should just take 3-4 weeks for it to process.

Because I thought changing to a spousal one was going to be quick and simple.. I should have guessed it wouldn't be.

According to the INIS I have to put in an application form first for a spousal one, not just turn up. There is no clear indication on any website of the right course of action as it mentions both appointments and applications, but it mentions the appointment first.

If you do not require a visa to travel to Ireland and you currently hold permission to remain in the State, you and your spouse/civil partner may attend at your local immigration office for permission to remain as the Spouse of an Irish National.
Assuming from your profile you don't require a visa.

You are correct but these are to two sections that make it confusing:
If you do not require a visa to travel to Ireland and you currently hold permission to remain in the State, you and your spouse/civil partner may attend at your local immigration office for permission to remain as the Spouse of an Irish National.
And
Your application must be submitted in writing to Immigration Service Delivery. You must complete the Spouse/Civil Partner of an Irish National application form and submit it by registered post, with all the required original documentation to the following address:

but it is being referenced above for the case if there's no permission:
Where you do not have permission to be in the State
You may be eligible to apply to Spouse of Irish National Unit, Immigration Service Delivery (address below) directly

If you become a spouse or civil partner of an Irish national who is resident in the State, you may attend at ISD Burgh Quay or your local immigration office with your Irish national spouse or civil partner to apply for a change of status to Stamp 4. Details here.

I actually rang them and the guy said to do it online to get an appointment, so I just went onto the ISD website and just submitted my form, will see what happens now.
