Hello Everyone,

I am PBS Dependent and completing SET O form for ILR, I had come across following question

"Have you had any absences from the UK during any leave granted since 11 January 2018?
(Required)"

I was out of country from 9th December 2017 and returned on 21st January, so Do I have to add this as my absence ?

Kindly advise

Thanks
It's is for leave granted from 11th January 2018 I.e. any absence for a leave or extension granted from the stated date. Will presume does not apply to you.
Thanks for your reply AmazonianX.
Just to be more specific in calculation of 180 days absence rule, My Visa journey is as follow.

1st Visa issue : 24/08/2016 To 08/01/17
1ST UK ENTRY : 22 SEP 2016

2ND LEAVE GRANT : 26/04/2017 TO 24/04/2019
3RD LEAVE GRANT : 09/10/2019 TO 09/10/2022

MY ABSENCE ARE AS FOLLOW:

list]16 MAY 2017 TO 20 JUNE 2017
09 DECEMBER 2017 TO 21 JAN 2018
10 JULY 2018 TO 25 JULY 2018
15 AUGUST 2018 TO 26 JAN 2019
11 NOV 2019 TO 8 MARCH 2020
26 APRIL 2022 TO 30 MAY 2022
[/list]

SO my questions are;

I should mention my absence from period of 2018? OR

i should mention my absence in the period of leave granted from 2019 to 2022? YES!!! OR

Should i just enter absence from 10th July 2018 till 30th may 2022?

Correct me if i am wrong in any of these please?
Also 180 days does not include arrival or departure day from Uk, right ? Correct it does not include them

i have to submit my application today, so anyone please advice on these would be much appreciated.
thanks.

You have to inclue the following:
11 NOV 2019 TO 8 MARCH 2020
26 APRIL 2022 TO 30 MAY 2022
All advice comes from personal research and experience and should not be regarded as professional opinion.

PBS-DEPENDENT ILR- Urgent Matter please

Post by Striker007 » Fri Oct 07, 2022 10:01 am

Hi all,

I am PBS dependent and going to apply for my ILR soon, my partner has been declared bankrupt last year 2021 (now discharged 2022) as he was personal guarantor in the business with other directors on various business assets, although it was not his fault as he was only 10% shareholder yet he had to honour the personal guarantee signed by him.

My questions is, do I have to disclose above information in my application or it is not required?

Also, does it affect application?

I am financially self-independent person and no involvement in his business matters.

Kindly advice please.

Only submit the relevant documents, if they're not mandatory it means they aren't needed. What kind of document are you thinking about?

Also can u tell Child Diability Allowance would be consider as public fund?

My Son's Nursery wants us to apply for that as he is having some difficulty in speech & learning. So i am not sure if we can apply now or just wait for our ILR to be proccessed & get decision ?

Kindly advice on this as well.
Sorry if u think its irrelevant question.

If the bills you have are spaced out 3-4 months that should be enough.

Depends on (a) where in the UK you are based (Scotland and NI have different rules) and (b) what is the UK immigration status of the child.

If the child is based in England or Wales, the child must "not be subject to immigration control" (i.e have ILR themselves) to be eligible for DLA for children.

Public funds for the purpose of immigration are listed on Page 11and 12 of the Public funds guidance. And both Disability Living Allowance and Personal Independence Payment (both allowances for people with disability) are on the list.
