FLR (M) 180 days outside country rule

Post by nani9 » Tue Dec 06, 2022 11:32 am

Hi everyone

I have a question on 180 days consecutive absence.

I’ve a British passport and my wife got dependent visa FLR (M) her extension was granted in beginning of this year and she will be eligible for ILR in 2024. My question is due to family circumstances in back home we travelling very frequently at the moment.

Outside the country from: 22 may 2022 to 21 June 2022- 30 days
Again: 03/10/2022 to 31/03/2023- 179 days

I’m not sure how this consecutive 12 months will be counted it starts from January to December every year or when our holiday starts (22 may 2022).

With the above absence she will be eligible to apply for ILR in 2024 or breaks the 180 days rule then she need to wait for another 5 years.

Any clarification on this would be much appreciated.

Thank you in advance.

Thank you @CR001 for quick reply.

When applying for ILR in 2024 this will not make any problem? Because her initial FLR (M) was granted in 2019 (which is after new rules January 2018).

Please can you send any link or guidance to say there is no absence limit for FLR (M) would be great.

Thanks

Because her initial FLR (M) was granted in 2019 (which is after new rules January 2018).
This applies ONLY to PBS route visas and not to flr M visas.

They is no absence limit rule for you partner. You are overthinking!!
