ILR to citizenship for child who is now major

Post by Hsrsham1112 » Wed Feb 08, 2023 7:46 am

Hi
I am a British citizen and expect my wife and son to get ILR. My wife wants to continue on ILR but my son wants to apply for citizenship. My questions are:

1. My son will be a major (above18years) when he completes 12 months on ILR. Can he apply alone for naturalisation since his mother will be continuing on ILR (since dual citizenship is not allowed in her country and she would like to retain it)

2. What application must he use? Understand minor children get registered but once an adult, he will need to get naturalised?

If son is still under 18 he doesn’t need to wait 12 months. He can still apply using form MN1. If or when he turns 18 during processing he will be invited for the ceremony.

Your son will also have to meet the English B1 and LIUK test requirements to apply as an adult and he must have 5 years residence which must include 12 months on ILR.

He also has the requitement that he must have been physically present in the uk at the start of his 5 year qualifying period.

Based on your previous posts, your son is already 18 and you only applied for their visas late last year from abroad.

I would suggest you focus on their 2 x dependent visas they need first and then ILR before you or your son worries about citizenship.

Thanks CR. We have now got the dependant visa for both and will focus on ILR. Just wanted to make sure my son can apply for naturalisation without his mother. For the dependant visa the rule was that both mother and son must apply together ( I.e both parents are required to be in UK along with son). Hence was checking whether same applied to naturalisation

His dependence on your and your spouse ends with ILR.

Naturalisation is different, each applicant has to meet the requirements individually.
