British and Mauritian National Marriage

British and Mauritian National Marriage

Hello,

I am a British National, I intend to marry a Mauritian National. In regards to getting her stay in the UK I believe I have two options, namely a fiancé or spouse visa. My preference is to try and get married outside of the UK as the spouse visa process seems less hassle.

We are Muslims, so are considering getting an Islamic Marriage (Nikah) in Pakistan. As far as I am aware, that will then be legally recognised in the UK and I can then apply for a spouse visa?

I would love to know if my above assumptions are correct and then what I am required to do in regards to progressing the spouse visa.

A legally recognised marriage in another country will also be recognised in UK.
Make applications on meeting the spouse visa requirements which includes but not limited to:
Show evidence relationship is genuine and subsisting
Meet English language requirements
Meet financial requirements of at least £18,600/year income
Provide TB test certificate if spouse is from a country on the list
Sponsor to show adequate accommodation for spouse

Are both parties "free to marry" in UK law (i.e., are they both single and unmarried at the time of this marriage)?

A polygamous marriage, even if conducted in a country that does recognise it, will not be recognised in the UK.

Thank you. Working on the assumption that the marriage in Pakistan is legally recognised in the UK. Will I still need to provide evidence "relationship is genuine and subsisting". If so, do you know why?

UKVI would want to see a) evidence that you have met in person, i.e. wedding photos or photos of the two of you together and b) any evidence of communication, such as whatsapp screenshots, trips together etc.

The rules have become more difficult since 2012 due to years of abuse so UKVI want to know that the person you are requesting a visa for, is a genuine partner.

Yes, you will need to provide such evidence.

It is to prevent marriages of convenience, where people get married solely for the purpose of immigration.
