Register my kids as British

Post by Attila80 » Fri Feb 10, 2023 11:43 pm

Hello to all
I am new so.. hopefully not breaking any rules
I am a EEA national and applied for British citizenship
This week I got the email from home office that my application was granted...and i emailed my council for the ceremony which will be next month
My boy was born in Italy and have IRL
My girl born in UK and also have IRL
Do I need to wait to get my citizenship certificate so I can register British both off my kids??

Or I can apply ASAP?

Last question:for both of my kids will be section 1(3) ? Or. section 3(1) ?
Thanks to anyone that reply

What is the immigration status of the other parent?

Your uk born child can be registered under section 1(3) when either parents have settled status.

Your uk born child did not need ILR or settled status. You could have registered the child as soon as either parent got settled status as a UK born child has an entitlement to register as British.

Your child born abroad can apply for citizenship when either parent is also apply and it is an application for the child under section 3(1), which is at discretion. So for this child, you will need to wait till your ceremony as you only become British at the ceremony

Another question
Does it change anything if I apply for my kid born in UK and select because I have ILR or.select that one of the parents have become British citizen?

For your UK born child, your ILR is the relevant status that makes them entitled to register as British. You becoming British is irrelevant to this.

No, you select the "Other" options, I believe the last one on the list, and is a Section 3(1) registration, at discretion. You are not yet British as you have not attended the ceremony. The option you quote above is if the child is applying at the same time as you.

It is asking details for the child. The child is the applicant not the mother.

Ok thanks for above
Before I go to the page of referees.....I am at the page:
Grandparent details
Provide details of your grandparent from whom your mother or father derived British citizenship by descent.

Me and the Mrs have no British grandparents in our family
In this one I have to say:

In do not don't know this details??
