Can I work while waiting for Long Residence settlement decision

Post by schan » Sat Apr 01, 2023 12:39 am

Hi,
My current sponsored tier 2 skill worker visa is due for expiring on 1st of August, my appointment for document submission is next Saturday, no option were given for priorty service so I checked up for standard service. Can i still work in the UK if I dont get my decision by August?
I am currently working in the NHS but should be working as an self-employed associate from 1st of August this year, i cant seem to find any information on this at all on the gov website.
Any help is appreciated.

If you make a valid application before expiry of leave, then, if after expiry of leave, they will treat your current leave as continuing under Section 3C, until a decision. You will still be subject to SW 18.2. Hence, I think it’s safer if you don’t work as self-employed associate until receiving ILR.

Hi,
Thank you for the reply, I understand that while waiting for my SET(LR) decision, i can only work under the terms of my current tier 2, of which i cannot as my current job is a 1 year training program, so i should not work until a decision is made.
While sorting through my documents today, i realised i cannot find one of my old expire passport between 2009 to 2014, which contains some of my entry stamps to qualify for 10 years. I do have a scanned copy of this passport, would the HO accept this or should i try to go find all my flight bookings or such to try to prove my residence otherwise?

As no original document is mailed or posted for the application, uploading the scanned copy should suffice.
