Current leave to remain granted under flr(M)

Hello, I’d appreciate if I can get a bit of advice on this forum.

My mum was initially granted leave to remain under flr(fp) 10 year partner route in 2013. Her fourth and final application was in 2021, but we did discovered that leave was granted under flr(M) which I think means that it had been switched to the 5 year partner route.

In April my mum completed her 10 years leave, however I’m afraid that the switch in 2021 means that the 5 year clock had been restarted and so she may not qualify for ilr this year.

My question is, is she able to apply for ilr given the two different categories or is it irrelevant? If not, will she be able to apply under the 10 year long residence by combining both categories? Thanks

She can apply for ILR based on long residence using fon Set LR.

Thank you, we thought as much. But we are a bit skeptical as her letter states that she can only apply for ilr after completing 10 years on flr(fp), since the final 2.5 years was on flr(M), I hope this won’t affect her application

Both visa count for ILR based on long residence, which has different rules to the family routes.

ILR’s qualifying period for the ten year partner route may include time spent on the five year partner/parent route. I think the application form is 10 year route (Settlement-Adult-Relative)

Thank you. We’ve decided to proceed with ilr long residence, but this is what it says in the government website:

‘Apply to settle in the UK – long residence
Use this form if you have lived in the UK lawfully for 10 years continuously and now want to apply to settle in the UK.

If you are the spouse or partner of someone who is settled and currently living in the UK and you have completed the relevant period of continuous leave in the UK using the 'Family Route', you cannot use this form. You must instead apply using the form Apply to settle in the UK - Partner of a person or parent of a child already settled in the UK.’

Does this apply to my mum since her 10 years qualifying period is based on the family route?

Hi you’ve written that time spent on 10 year partner route may include time spent on 5 year partner route. Do you mind sharing where you read this from as I couldn’t find it on the government website
