Skilled Worker Dependent Visa Apply

Post by CSun » Tue Jun 20, 2023 3:26 pm

Hello all,

Hope you are well!

I would love to apply for a Dependent Visa for my girlfriend. I would be really glad if someone could give us some advice on if she is eligible for a dependent visa. Here are some facts about us:

- We have been together for 3.5 years, and we have a lot of photos, travel receipts
- We have shared the utility bills for 1 year and 2 months, and we can provide proof.
- We did our master's degree in the UK at one university and have been living here for about 4 years.
- I hold a Skilled worker visa that will expire next year, and she has a PSW visa at the moment, but will expire in 1 month.

We read the document listed on the UK government website saying we have to provide proof of living together for 2 years. But, we are a bit confused if we meet the criteria or not. If not, what else can we do to prove our relationships other than marriage or civil partnerships?

We would be so glad if anyone can help!

Best regards,
Charlie

2-year unmarried partner requirement

If the lead applicant and the person applying as a dependent partner are not married
or in a civil partnership, they can demonstrate their relationship by providing
evidence they have lived together for 2 years before the date of application. This can
include:
• bank / building society statements, council tax, or utility bills
• residential mortgage statements or tenancy agreements
• official correspondence or documents that link the lead applicant and their
partner and show they are living at the same address

This is not an exhaustive list and other documents can be used to demonstrate a
relationship is genuine and subsisting.

The 2-year period of living together for a couple who are not married or in a civil
partnership must normally have been completed immediately prior to the date of
application.

However, the 2-year period does not have to have been completed immediately
preceding the date of application if, for example (this is not an exhaustive list):
• the couple are currently living apart for work reasons
• one of the couple needs to attend training in another territory
• one partner demonstrates they have significant caring responsibilities
provided that the relationship has existed continuously since the 2-year period of cohabitation and continues to be genuine and subsisting at the date of application.

The applicant must demonstrate both that:
• it was not reasonably possible for the other partner to accompany or join them
• there is evidence that the relationship continued throughout that period, for
example, by visits, letters, logged phone calls, shared financial accounts

Thank you for the reply! May I ask based on your experience, is there a chance for us to apply for a dependent visa, based on your description, the only thing we can provide is 14-months long shared utility bills, plus

- We have been together for 3.5 years, and we have a lot of photos, travel receipts
- We did our master's degree in the UK at one university and have been living here for about 4 years.
- I hold a Skilled worker visa that will expire next year, and she has a PSW visa at the moment, but will expire in 1 month.

I would appreciate if we can get any advice on this!

Given that you have lots of evidence, I'd say it is quite possible. However UKVI will have the final say. I'd say you should certainly try

It can take anywhere between a couple of weeks and 6 months.
