He cannot renew his ilr.brp card from India. Also, all BRP cards will expire in December 2024 and will no longer be issued and moved to digital status.

If you friend is out of the UK for 2 or more years, he loses ilr

He already has a card that expires in December 2024. What exactly does he want to apply for? He is NOT applying to renew his ILR. It is the BRP card that expires and is renewed.

There are at least three different concepts in this post that are getting confused.

PR in UK Immigration terms only applied (in the past tense) to specific people who acquired it automatically under the EEA Regulations pre-Brexit.

ILR is Indefinite Leave to Remain under the UK Immigration Rules and applicable to those who acquired it via work or spousal visas, etc.

So, the first question is, does your friend have PR under the EEA Regulations pre-Brexit or ILR under the Immigration Rules?

All PR has effectively expired with Brexit. ILR lapses automatically after any two years of continuous absence from the UK.

You may want to advise your friend to return back to the UK to reside in the UK before April 2024 (short visits do not preserve ILR status, they need to be returning to reside in the UK) to preserve their ILR status. The long absence from the UK will have damaged their ability to apply for British citizenship in the short term anyway.

If you are referring to the physical card, all BRPs (which are the physical Biometric Residence Permits) for all leave to remain (whether limited or indefinite) are scheduled to expire on 31st December 2024, when the UK will switch over to a wholly digital immigration system.

If your friend has a BRP with an expiry date of 31st December 2024, there is, at the current time, no need or possibility for them to renew their BRP. Assuming that they retain their ILR status (because they have returned to the UK), they will be automatically transitioned over to the digital system.

As you were advised, ILR is a permanent status and does not expire. BRP expiry card does not change this. Also, note that no new BRP are issued. The UK is moving to a digital status system in 2024. Your friend simply needs to move back to the UK and settle here, otherwise, his ILR will be lost after 24 months of absence
