Fiancé Visa to 1st Spouse Visa - 2 years living requirement?!

Post by CarlH88 » Tue Jul 11, 2023 11:53 pm

Hi all, very grateful for any help.

We received a fiancé visa and recently got married. Now applying for the first spouse visa and part of the application says it wants us to provide evidence we have been living together for the last 2 years?!!

This isn’t possible given she has only just come over to live prior to the wedding and this was on a marriage visitor visa. Haven’t lived together prior to that.

It is making me tick that will we provide this information but clearly that won’t be possible.

Any ideas? Thanks

The 2 years living together doesn't apply in your circumstances. Ignore it.

You stayed two different types of visas she came with, fiance visa and marriage visitor visa. They are not the same, cost different fees and only one allows you to switch to a spouse visa within the UK.

Really important to state exactly which one she applied for and currently holds.

Thanks CR001.

We applied for the visa which allows no work, study etc and is valid for 6 months.
The main reason being the allowance to get married, which we did. Cost was £1,500.

Confident we have the right one to switch to a spouse visa, I probably just called it incorrectly on my first post.

Thanks

The form is generic, go ahead and tick it so you can proceed with the application.
When CW is going through it, will see as it applies to you and attend to it as needed.
